woman sent to prison for "sexual assault" for misrepresenting her gender

    it does have to do with consent, if one lies about martial status or wealth, the women may not of consented

    but as for the case in the topic, remember, this love affair went on for years, they had consensual sex many many times, hardly rape

    now I do think adultery should be a crime again, much domestic violence is due to cheating spouses, if the victim could get justice legally, may be less domestic violence

    This seems like it opens a massive can of worms... but generally, I find it hard to argue with a jury.

    I guess they think people need the state to protect them from having to be discerning in their sexual partners.

    agree, if they had sex that many times, they knew it and denied it after, especially if it happened over and over for years - the years of having sex is the key part in this case

    What? She was pretending to be a man. She was pretending to be someone else. That female victim knew her as a friend, but she did not think the person she was having sex with was the friend she knew.

    I totally agree the victim was stupid and naive... which should definitely factor into the punishment (less punishment, barely any punishment).

    I honestly can't imagine any man would be that stupid or fall for that. But women can be a whole other story.

    she was being herself for years in the relationship, she was not pretending to be someone that had consent

    You assuming that does not make it so. You might as well claim that someone should know the difference between a real penis and a sex toy, regardless of ability to see. Obviously there are those who cannot.

    Tricking people into having sex with you is considered rape.

    Even though it went on for years, she was tricked.
    Although she was stupid for allowing herself to be tricked, especially tricked for years.
    I guess her female emotions were easy for the other woman to manipulate.

    I believe that falls into a little bit of a grey zone.
    It is a form of rape, sort of, but is not "rape rape".

    The woman claims she did not know it was a woman that was having sex with her, and she did not know that person was the friend that she knew.

    I totally believe her that this happened like she says, but it shows the woman was extremely stupid to buy all that other person's excuses, which prevented her from being aware of the gender of the person who was having sex with her.

    6 months in prison might have been a fairer punishment.

    Well, two separate juries came to the conclusion that this woman was guilty and had committed sexual violation against the other woman.

    Probably because this type of case is so unusual, and the logic questionable, is the reason why the woman was given a second new trial.

    disagee, it's wrong to lie to someone, about being richer than you are, being single, ect... but if two people have consensual sex, it's not rape

    Well, sort of. I think there is a spectrum.

    We can point to some examples of tricks that would both be rape and others that would obviously not be rape. A lot depends on what sort of details the woman is being deceived about.
    Concealing your actual gender (especially when the other person does not get a good look and feel of your body) is a big one.

    He was wrongly convicted for a completely different reason.

    In this case, I think we have all the facts. We just disagree about the logic and reasoning.

    Okay, what if we only view the first or last time as rape?

    If someone sexually violates you 10 different separate times, and you kept coming back for more, then that should only count as 1 violation under the law.

    I think that may be kind of fair.

    Ever read Agatha Christie crime mystery books with the disguises the criminals use?

    They typically use the disguises under certain very exact circumstances where no one would have been likely to pay attention, or where it would be hard to get a good look. The circumstances of the situation in which the disguise was used plays a big part in the disguise.
