It is generally recognized that Sekulow was the scribe for the questions. He was summarizing the discussions between Mueller's and Trump's teams -- not exactly an "author." But the issue and accusation was leaking the questions, not who wrote down the version. The NY Times, in a rare bit of candor and truth, said the source that provided them the questions was outside of Trump's legal team. Everyone else ballyhooing their false information are just jumping at what they want to believe is another gotcha moment.
In the final analysis that is true. Despite fully accepted principles and legal opinions officially put out by the DOJ, and clear constitution implication in the case of an indictment, SCOTUS most certainly might rule in favor of a subpoena and even a criminal indictment. It would not be the first nor last time a court would rule on what they think the law should be, not what it is. I think you should tell the NY Times that they reported their source incorrectly.
