    You havent been listening at all. There is no per se formula of that sort.
    Your window is as long as it is reasonable to believe them an imminent threat to life or limb. That depends on the circumstances.
    In this case, if a reasonable person would've realized an unarmed assailant backing up and turning to flee was no longer an imminent threat, the shoot is not justified. If not, then its justified.

    There simply was no reason to being scared the victim was out of reach unarmed and backing away, why would you be scared? Because he pushed you?

    The guy had a temper issues that got out of hand here. If he did threathen people like this before for little to no reason it seems quite clear what happened.

    That would be quite bad, again it would lower the reason to justify murder to "i felt scared" .

    He had spent some time in a concentration camp. He was violent because he got into an argument over a parking space in a large parking lot at Walmart. Now he's dead. The two cases illustrate that if you get into an argument over a parking space chances are excellent that someone will get killed. When that happens people will make thousands of comments on forum boards about the incident.

    Amazing how you defend a man cursing and yelling at a woman over a damn parking space that he can't even park in and the fact that he had threatened others.

    I am not defending him, I am just pointing out the fact that if you start cursing and yelling at a man's spouse it might be some ish. I guess some men would have just hid in the store.

    Well first why do you attempt to marginalized it? It wasn't just a push it was a violent attack that knock him off his feet and onto the hard pavement. And yes most self defense claims are entirely based on a fear of serious bodily harm or death. And the jury will frredtly take into account the REASONABLE fear one would have in under the circumstance.


    Again in order to make your case you must misrepresent what occurred. The reasonable man argument refutes your attempts.

    No it wouldn't and we'll have to see if the judge allows it in. But the fact is he attacker had no knowledge if it, all he saw was a verbal argument going on.
