    I think the courts will rule that the president does not have the constitutional power to use funds directly against the wishes of Congress.

    The courts can get involved right now. Trump’s actions will be ruled unconstitutional.

    This is not a national emergency being declared to shortcut Congressional bureaucracy and fund something Congress agrees needs to be done now.

    This is a President who didn’t get the funding he wanted abusing his power to take action against the wishes of Congress.

    It's based on current information. Sure some drug types have a majority trying to come through ports but the rest come over the open border along with the drugs not intercepted. The large percent at the ports is only due to them actually finding it. Since there is little coverage along the open border, intercepts are much lower so it is hard to say how much actually gets through.

    Also, interceptions of migrants is up 20k a month now compared to the last 5 years. That is 60k A MONTH, intercepted. How many are not intercepted?

    Except INTENT matters with the law. The purpose of declaring a national emergency is to take quick action that would take too long to enact by normal Congressional processes. It’s meant as a shortcut.

    Trump is trying to do an end-around of Congress to deliberately go against Congress’s wishes.

    The vast majority of cartel products are smuggled through legal entry points hidden in legal traffic. How would Trump’s wall stop them?
