Fact check: Could a President Beto O'Rourke confiscate assault weapons?

From CNN. Damn I am surprised that they actually told the truth..

"Former Rep. Beto O'Rourke of Texas has made his position on assault weapons crystal clear. "Hell, yes, we're going to take your AR-15, your AK-47," O'Rourke said during Thursday's Democratic presidential debate. "We're not going to allow it to be used against our fellow Americans anymore."

To accomplish this, O'Rourke has proposed a mandatory confiscation of these guns whereby individuals would be compensated for their firearms.

Beyond the thorny politics of this proposal, it raises clear legal and logistical questions, including whether a president has the authority to confiscate people's guns.

A gun confiscation program has about as much chance of happening as Mexico suddenly paying for “the wall”.

Weapon buybacks, limiting production, additional taxes or fees — possibly.
Going door to door to take weapons, no.

 

3 weeks ago I went to a meet-and-greet of the republican candidates in my area. One of the speakers was a sheriff who said just about every county in New Mexico is now a gun sanctuary and the movement has spread to Arizona and has even gotten some interest in California. So who is going to confiscate the guns?

Next question: How will they know who has the guns?

Lastly, they would need a search warrant to enter a home and some kind of authorization to confiscate the rifle. That would mean getting a warrant for each individual home and authorization specifically for the occupant of that home. That alone would bog down the courts for years.

O'Rourke is an idiotic fool.

The gun thing is a ship that sailed long ago. More people would die trying to take the guns than would die if they are left where they are.

I wouldn't mind seeing some restrictions on FUTURE gun sales and accessories, but trying to take the guns is just asking for chaos.

I need to ask you why don't you post all of your conspiracy threads and post in the conspiracy section? You accuse the media of not reporting things but we find that there are tons of reports.

 

Confiscating guns at this point besides being against the Constitution would be more difficult than trying to locate and export the 12 million illegals.

 

I care as much about gun laws (or anything else) in New [expletive] Zealand as I do about gun laws in Eswatini (formerly Swaziland).

Yes I heard the rest but that is not what is going into the political ads fir 2020. I would advise the GOP to make O'Roarke's confiscation words part of the main attack ads. If Biden gets in I would run an ad that. shows Kamalka attacking Joe and also Castro attacking Joe accusing him of forgetting stuff.

Exactly, here in blue state NM most county sheriffs have said they won't enforce universal background checks, let alone gun confiscation.

 

We'll never have to worry about it bc the ten year old brain dead immature skate border in a grown man's body will never get elected.

The current gun control arguments are rather stupid and misguided for a number of reasons. If someone wanted to be a control freak then the way to control the issue is to eliminate the ammo. The way the constitution is written, citizens have the right to possess arms but it says nothing about the right to possess ammo. Today's guns use manufactured ammo so, over time, guns become useless without the ammo. In some instances people can do their own ammo reloading but only if they have the necessary equipment and materials.

Therefore, a control freak would simply restrict the manufacturing of new ammo, prevent current supplies from being sold, and limit future ammo sales to authorized users and limited sellers, where maybe only police departments can sell ammo.

That way everyone can keep his guns but, once the ammo is gone, the gun becomes worthless except as a possible threat. There might be at least one bullet in it in 2078.
