Getting an indictment at the first hint of wrong doing is not hard if the prosecutor is corrupt enough and the judge and grand jury are from the right location. The standard to indict is a lot less than it is to convict. And even then a conviction in a political prosecution isn't that hard if you judge and jury shop. There's a reason partisan Democrat prosecutors judge and jury shop their lawfare. It's also why dark money is being so heavily spent in certain regions to get the "right" prosecutors elected.

Don't be so sure it will be thrown out, but it will likely be delayed and give Trump a chance to run out the clock before the election.
