    It will depend on what exactly she did in order to get the case going or keep it going in order to keep the money coming in. It could fall under either malicious prosecution or prosecutorial misconduct. And its not law, its what civil rights case law has determined. And no, you're not going to get a case law that explicitly talks about this particular type of case as there are MANY ways that malicious prosecution/prosecutorial misconduct can happen.

    I mean come on, you don't understand the concept of corrupt lawyers? Prosecutorial misconduct? Malicious prosecution? How being accused of such can affect the cases such lawyers have done or are doing? I don't know about Australia, but here in the US when a DA or Prosecutor has been shown to have abused their power or broken a law, then ALL of their cases are reviewed and gone over with a fine tooth comb. Depending on the area it could be throughout their entire career or just 10 years back or just 5 years back. Some people have gotten out of prison due to the above, even and up to those that actually did commit the crime they were accused of.

    First: She got to determine how much he got paid. I don't know about Australia, but here in the US that crap don't fly when the two are romantically involved.
    Second: She was paying Wade $100 per hour more than another lawyer under her employ who actually has experience in RICO cases. While Wade has NO experience in RICO cases. Is that how they do things in Australia? Put the guy with the least amount of experience as the head prosecutor AND pay him more than a person who has the most experience?

    You seem not to have read my reminder that a Grand Jury indicted Humpty and many others, some of whom have already pleaded guilty.
    Stop believing that because Fani was screwing Wade on vacations he funded, ipso facto, Humpty walks.

    Things do not work the same way down here as they do over there, thank goodness. For example, we do not elect DAs. Our State Attorneys General do not routinely get involved in the day to day prosecutions conducted by our various *Directors of Public Prosecutions/staff and even *they do not get to appoint *their own staff and set the salaries/wages/hourly rates.

    I have said it loud and long many times here, the judicial system in the USA is fatally flawed from the get go, and builds in cronyism etc. Hell, you even have a candidate for POTUS who says openly that to be a POTUS you have to be willing to 'cross the line.'

    Wade had other experience including mentoring, as Defence Counsel and a Judicial.

    I never said that Trump would walk. I did say it was a possibility if Fani and Wade gets taken off this case and its referred to another prosecutor. And it is. Its happened before. In fact its happened with a case that Fani herself was involved in in regards to fake electors and she got kicked off of it. No one has taken up that case and as such its essentially dead.

    Yes, a GJ has indicted Trump. That means nothing if Fani and Wade get kicked off this case and its referred to another prosecutor. Because if they do find another prosecutor to look into the case (they do get to decide if they take the case or not) that prosecutor will go through what's already been done by Fani and Wade, do their own investigation also, and then decide if the charges should stand, be changed to different charges (which might be easier to prosecute), or to simply have the case dropped. Additionally the case may be moved to a different district, which can affect jury pool selection, which can also affect the outcome of the trial, if there is one, to be different had it stayed in the original district.

    Even if Fani and Wade get kicked off the case and its referred to another prosecutor, that prosecutor may very well keep the case as is and go full out just as Fani would have. We simply do not know at this point. All of the above are just possibilities. Possibilities which HAVE happened in the past before.

    Quite frankly Dems and leftists should be PISSED at Fani and Wade, not defending them or trying to act like what they have done is no biggie. They are making it far harder to get a conviction against Trump. And some are criticizing them for doing just that.

    Yes, there are flaws in our system no doubt. I've said that many times myself. Some of those flaws are necessary, some aren't. I won't get into them here.

    As for being a POTUS having to be willing to "cross the line". That is actually very true. For instance a line was certainly crossed when the A-bombs were dropped on Hiroshima and Nagasaki. Sending in Seal Team 6 type groups in order to arrest or even kill people in other countries is also a line that needs to be crossed on occasion also. I'm sure even your government will cross lines when needed. And like ours, will justify it in some way shape or form. And then bury it asap.

    It would be grossly bizarre if after the Grand Jury indicted and many have already pleaded guilty that the prosecution of Humpty would be called off even if Fani and Wade are pulled aside.

    You have paid far more attention to this than I have. Though I suspect your sources are unreliable with respect to factual content. If Willis and her team is removed from the case so be it. It will be prosecuted based on the evidence regardless of who runs the prosecution.

    There was a judge in Georgia named Pascal? English. I may have the spelling of his first name incorrect, but you can find it if you search. He was on an early season of the reality show Survivor US.

    He got caught having a secret relationship with a public defender. When that was uncovered they reviewed all the cases they had together and determined that their relationship did not negatively impact any defendant. If anything, their relationship could have been a benefit. However, that doesn't matter in America because we cannot allow even an appearance of a conflict of interest in the prosecution of a defendant. So every case with a guilty verdict the two worked on together had to be heard all over again with a new judge and defense attorney. Everything they did together had to be thrown out to protect the due process rights of the defendants. Their relationship threw a wrench in everything they touched. There was no monetary benefit to anyone involved. There was just an appearance of impropriety.

    This is similar to the DA and lead prosecutor going after a political rival while she benefits monetarily and personally by the prosecution of the defendants. Imagine being a defendant and believing the prosecutor was acting unethically during your trial and the DA should have stepped in to resolve the issue. But, the DA never did. Was it because she was in a sexual relationship with the person and benefitting monetarily? If she stepped in to do her job it could have negative consequences on her sex life and her luxury vacations paid for by the prosecution of the defendants. That is a perversion of due process. The appearance of impartiality cannot be an issue in the prosecution of a defendant. The US wasn't founded as a penal colony. We believe in a fair and just process of criminal law. This isn't a difficult concept so I don't know why you keep asking such basic questions.

    But, surely you can appreciate the difference between the instance you cite and the allegations against Willis since the latter instance does not involve someone in a position to rule on the guilt or innocence of a defendant.

    You do understand (or not) those that "plead guilty" have their convictions stayed and will be guilty of no crimes and their charges dropped after they play the little games with Georgia and keep their noses clean, and the whole judgement expunged from their records. Please consult a real lawyer and he/she/it can explain it to you..

    What you're calling for, is exactly "sycophantic justice". You don't care what rules are broken, rights violated, laws broken as long as Trump gets convicted.

    In the future, stop pretending it's all about upholding the law, or the Constitution...lol

    No WBK, that's what you are calling for but in your case it's actually sycophantic injustice. Willis will not be charged with anything other than exercising bad judgement PROFESSIONALLY and like should have the prosecutor recuse for a better look. Trump will face CRIMINAL charges by a jury of his peers, this is the way of the Rule Of Law.
