The 14th Amendment says...

"No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States;"

...which pretty much means that state gun control laws are unconstitutional.

It says after that, that...

"nor shall any State deprive any person of life, liberty, or property, without due process of law;"

...if Congress passes a law that prohibits illegal aliens from owning, or possessing firearms, then that's "due process".

It doesn't say "constitutional rights apply to any person".

I doubt this will stand as it goes up the chain. I believe this just some kind of gambit played by the judge, in order to trip up pro-gun arguments down the line.

Before I post my opinion, I want to ask why knowing the background of the gun buyer is no longer important? After all, there is no way to check ones background when one is undocumented.

I don't think more guns is a good thing and I differ from republicans when it comes to the role of government and gun control. I don't know the ins and outs of what type of immigrant can possess weapons here.

 

The form doesn't make it illegal, the law does.
