What investigation said her use of an unsecured unmonitored server to store highly classified information was proper. Even Comey had to admit it was never approved for such use.
Gross negilgence is what gets you charged. She knowingly set up the server without proper authority, approval or monitoring. And it's not just her but the 38 other people involved.
