It's actually a bit more subtle than that. I wish reporters were more precise with headlines. From the sacbee article which was linked in the zerohedge article. Willful defiance (at least in schools I worked in) means the kid just said "no I won't do that" etc. That is a specific term. While I do think that willful defiance should be a suspendable offense, I think a better alternative is "In school suspension" (ISS) in which a kid goes to school to a special room, usually with library style study carrels (so they can't see anything but their desk), and is sent work by his normal teachers. In most schools, the kids were required to complete all assigned work (and have no other disciplinary problems) for their time assigned to ISS. If they disrupt ISS, then they are sent home for a couple of days for disrupting ISS. When they return, they have to complete their ISS sentence. When I was a teacher, I would pile on the work for ISS students. In one case, I ended up giving the student 6 weeks worth of his missed assignments. He ended up passing my class by the skin of his teeth due to ISS. Anyway, if I were a 4-8th grade teacher in California, I would simply get more creative with my referrals. Instead of calling it willful defiance, I'd nail them with some other creative offense title.
