Flynn and Kushner met with the Russians to set up an ILLEGAL back channel via the Russians spy equipment. This evidence was provided by the Russians themselves and given the leniency for Flynn he obviously corroborated it with Mueller.

The meeting with the Russians in Trump Tower is also documented and we have people who attended telling the SC investigators what actually was said and by whom.
