Credibility is subjective and based on a whole host of factors. Again, a jury is wholly within its right to convict someone based purely on testimony if they believe the testimony is credible. Even in the absence of corroborating evidence.

I want to be clear that those situations are extremely rare though because Prosecutors almost always make the decision to not pursue a full length jury trial under such a scenario (the only evidence is the eyewitness testimony). But it is absolutely true that eyewitness testimony is a type of evidence that is routinely used as the sole or primary reason for a conviction.

Didn't happen that way. He may have gotten mugged, but I question that he was singled out because he was a black gay actor. This guy once was reputed to have one of the finest legal minds in the country, on a short list for SCOTUS and now he's ready for the loony bin.

This guy is a Professor of Constitutional Law at Harvard, has taught at its Law School since 1968 and was voted the best professor by the graduating class of 2000 and he has taken complete leave of his senses.

I don't know what to think here. What is credible? The actor dude is a mess. The story is a mess, and the story itself is important because it frames a reality that many folks in the gay community contend with all the time. One only has to remember the events surrounding Matthew Shepard and the horror comes flooding back. It happens. But, did it happen here? There just seem to be too many things that don't add up here, and I hate to not believe the guy, but the idea that somehow two guys covered head to toe because it was like -20F waited on the off chance that they could douse the actor while walking on an unscheduled munchy run just seems unlikely. Crime, like this, is methodic. Folks would want to plan for it. You'd have to be able to be precisely where you would have both the opportunity and the patience to execute it. And here we are, lots of doubt. The chemical, (liquid bleach) that wasn't somehow frozen from having to wait for the victim to appear...

Well first I was no obligation to give him a "theory" about anything. I was stating the facts which he can't deal with. But I did and he has yet to give his "theories" about all the feaxks in the story.

 

Keep in mind that there was more to the Matthew Sheppard story that came out later. A horrible crime, but, what didn't get much coverage was Matthew’s drug abuse, and the fact that he knew one of his killers prior to the attack, and that it was rumoured that the killers knew that he had access to a shipment of crystal meth with a street value of $10,000 which they wanted to steal. We may never know the whole story.

 

I said that sworn testimony is proof. Allegations are a sufficient reason to investigate.

 

Reporting that statement to TMZ, even if it directly contradicted a previous statement delivered to the police (so long as he told the police the truth), would not subject him to any criminal or civil liability.

Claiming that someone said, "this is MAGA country" is not relevant to the identity of the perpetrators, the location of the crime, or I do not believe that it would be even be relevant to whether their actions are subject to specific types of criminal liability, like a hate crime statute.
