    Is it not "cruel and unusual punishment" to separate males from female contact for stretches of 10 years at a time? Being deprived of female companionship for so long can do twisted things to a man's sexuality. :omg: Besides, is not this type of gender segregation equivalent to discrimination against heterosexuals? Of course, I am not saying that all prisoners should be allowed female interraction: serial killers, rapists, and fathers who are in prison for refusing to pay alimony!

    How does the USA Supreme Court ruling that "separate is not equal" apply in this situation?

    Several other countries make much more allowance for prisoners to have "conjugal" visitation with their wives or other female prisoners.     I'm an Australian and even I'm aware that cruel and unusual means cruel AND unusual, which allows both cruel punishments and unusual punishments, just not in the same punishment. Since gender segregation is USUAL you lose your argument right off the bat.

    The Constitution also makes provision for the right to keep and bear arms. Would you suggest that we allow inmates to go armed?

    Then perhaps the prison should also be racially segregated.

    Not only should prisons be gender-segregated, there should be weight class differences in the prison. All of the fighting sports (i.e. wrestling, boxing, MMA) rely heavily upon weight classes to make fights “fair”. Given the propensity for violence in prisons, the same treatment should be afforded to inmates to avoid the 125 pound man (or woman in a female prison) being raped by a 300 pound man.

    The plain truth is that racially segregated prisons would drastically reduce prison rapes, and prevent the spread of AIDS, both within the prison, and to the outside world. Prisons are one of the primary breeding grounds for AIDS, not least of which because rape and anal intercourse carry a much higher probabibility of sexual transmission (both rapes and anal intercourse are much "rougher", leading to microtearing of skin. even when a condom is used, chances of transmission of disease are still higher)

    But the multiculturalists refuse to look at the facts. Their ideology of racial integration must override any and all problems that such policies may cause. If there is a serious problem in America's prisons, there needs to be a serious solution. Multiculturalist politicians and media are ignoring and refusing to discuss the issue.

    If you are against racial segregation in prisons as a solution, it is rather inconsistent of you if you also support the gender segregation of prisons.

    Hasn't there already been a solution for prison gender and violance issues for centuries?

    Up until the 19th century, prisons were NOT segregated by gender and race, but every (male) prisoner got routinely castrated during the entry booking process.

    This actually makes a lot of sense, if you consider that every prison has always been crowded, and even animals reduce their agressive crowd tendencies upon castration.

    Also, after (male) castration, the rights of conjugal connections or gender separation are automatically resolved.

    SInce when is contact with the opposit sex a human right? There are some prisons that have prisoners in 23 hour a day lockdown without 0 human contact and no visitation.

    Is that all?

    So what could be done then about inmate violance? Isn't that mostly sexually motivated? How can a (prison) legislation use paper and print to get effective against the prohibited "sex life" of inmates? Can you stop human nature by legislating against it?

    Is that a safe bet that prostitutes are allowed to visit prisoners because that reduces violance?

    it was because the prison was corrupt and some criminals were running it like an exclusive hotel.

    no - violence in prisons is not mostly sexually motivated, although a considerable amount of sexual abuse in prisons is motivated by desire for power at least as much as by desire for sex, and does involve violence.

    At the very least, they should separate the inmates who are strongly suspected of having raped other prisoners, and put them into a separate area. But the fact is they do not do this.

    The prison system seems to have very little concern about the rapes going on in its prisons. It is almost as if they feel that "prisons are not supposed to be a nice place" and that the potential of rape in prison will just be one more deterrent to potential criminals. This attitude fails to consider that spread of HIV after the prisoners are released into the rest of society.

    It is not humane to make prisoners stay in cells all day for decades. It is also not allowable that any prisoner should be treated differently based on race or gender. I also agree in not having cruel or unusual punishment---however I believe in the ORIGINAL meaning and concept of the term as laid down by the Founders 200 years ago. I do not support the warped ideas by judical hacks like Warren and T. Marshall.

    The solution:

    For many violent and first timer offenders, spend the time between dawn and dusk linked on chain gangs doing hard labor outdoors. Five years of doing this is enough to get the point acros to most. Those that have disicpline problems should be given corporal punishment with a whip (not flail) or club as was the common custom. Those prisoners who violently attack or rape others should face automatic execution.

    Non-violent first timer should generally be "rehabilitated" through boot camp programs.

    All very violent felons, or those who have been convicted of 3 or more violent attacks should always be executed after a very brief appeals process. Hanging being the most logical choice.

    Agreed. I do not think the prisons should be so much about about harsh retributive punishment.

    I very much disagree. I think most prisoners would prefer to be amongst their own kind (racially), if given the option. There is obviously much race-based violence happening in prisons. Segregation could dramatically reduce violence. Putting prisoners in a situation where they have such a high chance of being infected with HIV against their will is inhumane. Racial segregation would thus give prisoners more rights than racial integration.

    Seems potentially harsh. I think this punishment should only be applied to certain prisoners, so that the punishment better "fits" the crime.

    We can only hope, but unfortunately this is never going to happen in the "progressive" provinces and countries. Certainly prisoners that repeatedly rape other prisoners should be executed. You do realise that this will get rid of around 20 percent of the black incarcerated population?

    Only for the most violent offenders who are incapable of living peacefully with other inmates.

    If you are serial rapist, or have a recidivism problem with assaulting fellow inmates, you must be placed in a "prison within the prison".

    Also, the problems of gang activity are prevalent in American prisons, where gang members are able to use the freedom of general population to plan and enact illegal activities on the outside world, from inside the prison system.

    In American prisons, the social structure is controlled not by the guards, but by the inmates. The inmates create their own society within the prison and really run it on a day to day basis. The guards are there mainly to keep social order from descending into chaos.

    No, it is not cruel or unusual punishment, many people not in prison go much longer than 10 years without contact with the opposite sex.

    there is no constitutional right to have sexual intercourse. If there was it would be a violation of someone's rights to tell them no.

    Plain and simple.. there are a lot of reasons to stay on the right side of the law. One of them is physical contact with the opposite sex (unless you are repulsive). Freedom has it's rewards. Want poonanny? Don't commit felonies.
