    You’re assuming he was operating the vehicle on a public way. He’s in a parked car off the road, no movement. In some states, the car has to be moving has to be decided in court. You write a summons.

    "This generally applies to drivers who have pulled over and are sitting in a parked car. Being in physical control of the vehicle carries the same penalties as DUI. The state’s logic is that intoxicated drivers in a parked car have the potential to drive while intoxicated. Unfortunately, drivers trying to be responsible by pulling over when they realize they have had too much to drink can be caught by this law. If you realize you cannot drive safely, make sure that you have someone pick you up or get a taxi. Instead of pulling over to the side of the road, pull into a legal parking spot whenever possible.     And he wasn't just pulled over for safety, he was going through the drive through. They've gotta test him at that point. He was a dangerous idiot that needed to go to jail.

    A “dangerous idiot that needed to go to jail ?“ That says it all right there. DUI doesn't necessitate Going to jail. You’re really showing Predudice. I did this s.h.i.t for ten years. He was cooperative, walking distance from his sister. You have his car, a license, you can easily summons him for DUI, public intoxication, trespassing and a who knows what without arresting him. He goes to jail for a misdemeanor ? That’s for the courts to decide. You only arrest people for safety in transport to proper authorities. Cops don’t decide who goes to jail. Being black isn’t so good is it. You just made my case.

    Conspiracy? You might think that it's a joke that black people are treated different by cops while the statistics show that this is how it actually goes down. But the statistics are overwhelmingly proving that racism is institutionalized exceptionally well in the US against the black population. Who knew right, when the predominantly white community has a very nice history of apartheid rule against black people. Heck, even Donald himself could have fully enjoyed the totally legitimatized US governments policy of apartheid rule in the US army,.. if he wasn't such a coward of a draft dodger.

    It does in my state for a DUI gross misdemeanor. I could care less what color he is and I'm sure the cops didn't either. Don't apply your racism to them. How do you think he got that vehicle to the drive-thru?

    So, everyone who fails a test for DUI after sleeping in a car is a dangerous idiot who has to go to jail ?

    You live in Atlanta ? Because it doesn’t matter otherwise.
    Obviously, the DA in Atlanta feels it should be handled differently. The cop is charged with felony murder....

    I don't care what state you live in, driving drunk is a very dangerous thing.

    Speeding is a very dangerous thing. This guy was sleeping. And what is your point ? DUI is heavily fined, you can get prison time as misdemeanor on subsequent offenses. You can lose/suspend your license, impound your car....but we don’t shoot them. Nor, is it necessary to always cuff them and kick them after you shoot them twice from the back.


    , Kennedy was drunk, left the scene where someone died and got a slap on the wrist with no felony charge . A Poor black man or poor any man looks at involuntary murder, several years in prison and a felony on his record.

    They called for medial help before he went down they didn't hold him down for 9 minutes and THEN call for medical assistance.

    Leaving the scene of an accident that involved a deceased victim was always, is now and will be a FELONY.
    That he was drinking too is the lesser of two evils. When you’re well off and white, like Trump and a gazillion others you get away with crimes

    They didn’t “hold him down” for that time, the cop choked him for that time.

    While on the ground, after being shot twice from behind, do you suppose they kicked and stomped him while he was dying for drunk driving or is it because he was running for his life ?

    Doesn’t look like it now. Clinton put more cops on the street and cut crime. Added 100000. GOP has a history of cutting cops and replacing it with tough talk rhetoric . Never worked any better then trickle down.
