so with this new executive action in place. What happens if a gun owner gives away a gun as a present? Since its not a business function and there is no profit where does it stand? Seems like a grey area. Guess you wouldn't need to do a background check as your not dealing.

    any thoughts?

This area, unfortunately, could present a loophole.

We could make it a crime for felons to own firearms and for people to knowingly furnish felons with firearms. Seems like an easy way to close that loophole and not burden the 99.9%+ who are not criminals.

This has nothing to do with what Obama said today. The regulations already exist to answer your question. It depends on whether the gun gift is a new gun or one that you've previously owned and whether or not they live in the same state. If they live in a different state, it's important to know if the gun is legal in that state, as that varies from state to state. This is from the ATF website:

Sure. My grandfather passed down many guns to our family members.

I used to go to my Grandfathers farm in Pennsylvania . He would lend me a rifle to go shoot with my uncle. Is lending a retaliative a gun now going to be a crime?

Well, how can you define someone as a gun dealer, if they aren't selling guns? It's not a loophole, it's just logic.

Well, we already have a law that does the above.

Those days are gone of leaving gun collections to family after death.

A "gun collection" in a family is too often a CAUSE of death …

Again: think: Nancy and Adam Lanza ...

How many gun deaths annually in America due to "domestic violence" … ??? suicide … ??? accident (kid shooting another kid) … ???
hint: it's more than one …

No, I'm not an M.D. … but I am a trained experienced Mental Health Professional (in locked hospital ward; super max prison; community agency; nursing home) …

Now think of the other 100,000,000 gun owners who didn't do anything wrong. It's a non-issue, it's just made one by the left so they have a device to attack the right and gain ignorant voters who are scared of guns.

Thank you for the straw man attempt …

I happen to be a (responsible) gun owner … but NOT a "gun nut" who wants NO restrictions and controls ...

Please elaborate on what makes you a (responsible) gun owner. Guns in safe, guns broken down, ammo and guns stored separately, handguns, long guns, shotguns, no 'evil assault' weapons.

Got a real nice Springfield XD/M 9mm for Christmas courtesy of Mrs. Claus another responsible gun owner and God bless her, course I had to do the background check but what the heck, for the gift under the tree.

Nothing. You can give a gift but if you are giving to uncle Harry and you know he is a felon, you might have a problem.

Obama would be better off enforcing all the current regulations instead of politically masturbating on stage for us.

Counts as a transfer. It's covered by the new regs.

Nah, what is true is that very few felons are ever prosecuted for trying to buy firearms. They got better things to do.

I believe you have your facts wrong there. The guns were hers, her son murdered her as she slept then stole her guns. He broke several laws that tragic day. Just going to show that criminals don't care about laws.

Nancy Lanza was a gun nut who indeed bought guns specifically for her crazy son and made sure he knew how to use them ...

It shows you that Nancy Lanza -- while POSSIBLY following the letters of the gun laws -- was a gun nut who made stupid fatal internal family mistakes by making guns and ammo available to her crazy son … Yes, she did that ...

Have a question for you. Would you support a law that made it a felony for the gun owner if the gun owner had a gun stolen?
