Does anyone see the irony here? Trump tells Europe to repatriate their ISIS fighters at the same time the US is rejecting it's.

If she is an American, she has committed treason. It is an open and shut case. Try her in absentia, convict her and impose the death penalty. Let her know that if she comes back, she is going to death row. She can have her life and be with Muslim people who share her culture and values or she can come back and be executed.

I. Is Muthana an American Citizen?

This, of course, is the big question. The government apparently does not dispute that Muthana was born in the United States. Instead, the argument against her citizenship appears to be that her father was a Yemeni diplomat posted to the United Nations, and that children of officially accredited foreign diplomats born in the United States are not entitled to birthright citizenship under the Citizenship Clause of the Fourteenth Amendment.

As a matter of law, that claim is correct. The key here is a question of fact: Was Muthana’s father in fact a Yemeni diplomat at the time of her birth. Rukmini Callimachi has reported, for example, that her father’s U.N. posting terminated one month prior to Muthana’s birth. There’s a little gray area here; in order to decide whether individuals are entitled to diplomatic immunity, Article 39 of the Vienna Convention on Diplomatic Relations recognizes immunity for a “reasonable period” of time between the end of an assignment and the diplomat’s departure from the country. But that wouldn’t necessarily apply if, as has also been reported, Muthana’s father stayed in the United States and applied for permanent immigration status.

Moreover, Callimachi also reports that, when Muthana previously applied for (and received) a US passport, “her father was asked to produce proof that he had been discharged from his diplomatic post.” Thus, not only does it appear that she was entitled to citizenship at the time of her birth, but that the State Department itself so concluded as recently as 2014. To be sure, the State Department’s prior determination is not necessarily conclusive. But it is deeply suggestive of the conclusion that Muthana’s father was, as a matter of law, no longer entitled to diplomatic immunity at the time of her birth, and so her birth on U.S. soil entitled her to birthright citizenship. At the very least, it’s a matter of some dispute, and not resolved simply by the Secretary of State’s ipse dixit.

 

Welcome her back, then try her for treason.

The ISIS Bride's citizenship turns on the timeline of her father's diplomatic status at Yemen's Mission to the United Nations in New York, where he served as a Yemeni diplomat in the early 1990s, before becoming a naturalized U.S. citizen. The ISIS Bride was born in New Jersey, in October 1994. The U.S. does not consider children born to foreign diplomats in the U.S. as entitled to American citizenship. The ISIS Bride's father claims he conveniently lost his diplomatic status shortly before she was born, ergo she's a citizen, Obama's State Department said in a letter dated Jan. 15, 2016, more than a year after she'd gone to join ISIS in Syria that U.S. authorities were not officially notified of the termination of her father's diplomatic status until February 1995, four months after the ISIS Bride was born, ergo she was not born a U.S. citizen, has never been one, and should never have been issued a U.S. passport.

It probably wouldn't be for treason, but that's exactly what should happen here...

It would be an ideal public case to make to anybody else considering this terrible life choice that it was a huge mistake.

She does time, probably less than Lindh's 20 years.

It's all good except for her kid... that's a much tougher call... he has no legal rights to citizenship..

 

Actually Treason fits well if she is a US citizen, which looks doubtful. She was born here, but to a foreign diplomat who enjoyed diplomatic immunity as a representative of a foreign state of Yemen.

 

Well it effing well shouldn't be then! Traitors are enemies of their countries and should be treated as such.
