    He was allowed to nominate. He nominated Garland. He wasn't able to see his nominee confirmed because he lost the Senate in 2014.

    the GOP will be history soon..

    before the GOP crumbles , it will have taught the dems every dirty trick possible

    trump has played the system no doubt..the dems will so exactly the same things he did

    By this logic the only way a party can get someone on the court is by having the presidency and the senate at the same time. Has that historically been the case? Hint: it has not. If Trumpturds will do anything for power then I don’t see why Dems shouldn’t just pack the court when they return to power. Two can play this game.

    Here's the scenarios.
    The only way that they could get her confirmed prior to the elections is if the senate stays in session and that would mean no campaigning for the Senators up for re-election and a virtual guarantee of a Dem senate in January. They won't like that.

    If they choose to fail to do any due diligence and rush the job they will have handed their opponents one huge talking point.

    If they wait until after the elections then they risk going down in history as to only lame duck Senate confirming a lame duck president's choice. Not to mention the incredible amount of backlash over the hypocrisy since Garland didn't even get a hearing in over 10 months.

    If by some chance the Republicans retain control of the Senate but not the White House and they go forward anyway with the new Senate look for Senate recalls to start.

    If the Republicans retain both then it's a moot point.

    For the record. I'm not terribly concerned about Amy Coney Barrett becoming a Justice. She is qualified (unlike the last two) and I have little doubt that within a year she'll be a swing vote and 5 years tops to become a liberal vote.

    If Republicans go through this and get the votes (I hear Murkowski and Collins are currently no-votes), as Schumer says, "nothing is off the table" were the Democrats to retake the Senate and the WH (both very likely).

    That includes the filibuster and likely SCOTUS expansion.

    EDIT - This is an interesting article I read this AM, that could have an impact on the SCOTUS voting. Kelly is almost a stone cold lock at this point

    That's a wall of words, not a caveat. Since Hurricane Maria, they want to become a state. If the Dems indicate it is for real this time turnout would be huge and the vote to become a state would be overwhelming.

    That was entirely on Pelosi and Clinton who wanted Clinton to get the pick. The Dems should have immediately taken the case to the Supreme Court to force a vote or to declare the Senate derelict in duty, allowing a pocket appointment.

    So, we can only fill a SCOTUS seat when the Senate and White House are controlled by the same party? How about other appointments requiring confirmation?

    It wasn't "because of one man". If a majority of Senators had wanted to consider his nominee, they could have voted to do so. They did not.
