What do you plan to do, force people to exercise, stop smoking and eat properly or be imprisoned by the government?

The chances of you dying in the next 100 years is 100%, the chances of you enjoying any meaningful freedom is swiftly dropping to 0%. This is why allowing liberals at the levers of power is an existential threat to America.... they want and need to be controlled and they want to force this slavish attitude on the rest of America. Given that America has never had a more corrupt and incompetent set of elites in our history, there never has been a worse time to allow them even more control of our lives.

I'm not saying Covid justifies their use of the power, but a more dangerous emergency could justify government measures.

Constitutionally speaking (and depending of course precisely what measures you're talking about), the correct answer is, in fact, "no one". However if a situation is grave enough that it calls for extra-constitutional legislation to be passed, the people who wrote that document provided us with a process to make that happen. It's called a Constitutional Amendment, and while it's damn hard to get one passed (as it should be), if the need is serious enough, I bet they could get one through inside of 24 hours, especially if it included clauses like sunset of the new Amendment after X amount of time had passed and/or significant restrictions on the language to ensure it means exactly what they want it to mean, and not an inch more.

People seem to have forgotten that the Constitution doesn't tell the Government what they're not allowed to do, the reality is it does the exact opposite and tells them what they are allowed to do. And if any desired power isn't in there, they simply have two choices... get an Amendment passed granting that Authority, or forget the idea altogether.

It's kinda like the question of why was an Amendment required to ban booze, but they can just ban weed by passing simple legislation? The reality is they cannot just ban weed by simple legislation, but sadly the courts have allowed them to do so regardless. The entire document has been pissed on and passed over as if it really was a relic of a bygone era, but it's not. It's still there, and it still (in theory, anyway) in effect, and it sets the terms under which our governments are supposed to live.

If Mt Saint Helens was showing signs of an imminent eruption, local and/or state governments would have the power to order an evacuation just like last time. If a bar owner defied that order, and an eruption killed 10 of his patrons, do you think your unconstitutional defense is going to hold up if the government came after him for defying that order?
