    Depends on how much was in those three bags in his motel room. The question is why wasn't he charged at all?

    Florida
    • Possessing 14+ grams, but fewer than 28 grams results in 3-30 years in prison and a potential fine of up to $50,000. The minimum penalty is 3 years in prison.
    • Possessing 28+ grams, but fewer than 200 grams results in 7-30 years in prison and a potential fine of up to $100,000. The minimum penalty is 7 years in prison.
    • Possessing 200+ grams of methamphetamines incurs a minimum penalty of 15 years and a potential fine of up to $250,000.

    Even if it was 3 "8-Balls", that is only 11.5g.

    That is a chump misdemeanor charge and they might not even be able to prove "constructive possession".

    And, even if charged:

    first-time cocaine offenders with small amounts of the drug can sometimes qualify for diversion programs.

    The D.A. probably figures that it is a Waste of Time and Resources to even pursue this nickel and dime BS.

    Many states now have Legal Weed.

    Before the law was changed, weed smokers were "criminals".

    My advice:

    1) Don't get caught.

    2) Don't do the crime if you can't do the time

    In any event, just b/c he was in the room Does NOT Mean that he was "Technically in Possession".

    Now, is it really worthy pursuing the case based on "Contructive Possession"?

    Who knows?

    In any event:

    Possession of Methamphetamine is assigned a Level 3 offense severity ranking under Florida’s Criminal Punishment Code and a judge may sentence a person convicted of Possession of Methamphetamine to probation.
