    That's as you perceive it.

    And as I have already suggested... your "factual" view or something similar, WILL be tested eventually by some case (or many) in our nation's courts.

    Certainly, we won't resolve a thing here. But it is interesting to share views/opinions, to at least see what others think/believe.

    Tell me what is meant by the people? It does not say only people who are in a well regulated militia.

    Don't be depressed. Many people have had to work on America's laws (especially minorities), to garner even equal rights.

    I would say that "God" defines such rights, but look around the world and even at the 'massive' range of "Christian" denominations (specifically); you find full agreement there either.

    It IS troublesome that we don't have perfect answers for anything, but that is hardly a new thing.

    That our rights come from our creator is the basis of our system of laws.

    I'll tell you what. I'll vote for banning guns, the day that you vote for banning abortion. What do you say? How about it? I'll vote to ban guns when you vote to ban automatic citizenship for babies born to illegal immigrants. How about it? Let's meet half way....

    There is hope for ALL of us, especially if we actually placed LOVE (spirituality) forth as the primary weapon (tool) to take care of this worl'd problems.

    I know some people don't abide my view, but I'm pretty sure after 35+ years in the military and watching what humans do... guns/bullets (bombs) don't really solve problems.

    I'm not sure I understand your argument. What do you mean by "carry an weapon you want"?

    Where is the problem now with those who legally arm themselves either open carry or CCW? Statistically they are safer to be around than someone who doesn't have a CCW, and by a large margin.

    The extremely vast majority of gun violence in this country is perpetrated by the same people over and over, as shown by recidivism rates when it comes to violent crimes.

    I really wish they would separate gun violence statistics into those with criminal histories, and those without. Then it would be clear where we should focus our efforts.

    Just because you make the same statement over and over again, doesn't make it any more right. You're wrong, deal with it. Or don't, I don't give a (*)(*)(*)(*). Argument over on my end, because the Second Admendment ALLOWS me to own a gun. It's been tested over and again.

    That might have been the way people felt about things in the 1700s but, tell me, when the 2A has ever been used by the people to secure our free state? That part of the 2A is an anachronism. If the state wanted to, it would simply brush the people aside.

    Prefactory clauses have no effect on operative clauses. The bit about the militia is a prefactory clause which has no effect on the operative clause "the right of the people to keep and bear arms, shall not be infringed". Any other time right and people is used in the same sentence in the BoR its an individual right (4th for example). The constitution disagrees with you by construction, the english language disagrees with you by same, and SCOTUS does to boot.

    If you'd like to jettison the thing, see Art V. There are 2 methods. Choose one. I'll wait.

    Congress clearly defined what "well regulated" means when they regulated and registered firearms in the Militia Acts of 1792 right after the BoR was ratified by the states.

    And the founding fathers clearly defined what was intended with the 2A by creating the Bill of Rights to protect individual liberties, and then putting the 2A in it.

    Which does not in any way nullify the ability of Congress to regulate the 2nd amendment just as it regulates the other rights.

    And in what way does congress regulate other rights, and where do they have the authority to infringe on the Bill of Rights?

    Regulations do not "infringe" upon the BoR.

    Your right to free speech is regulated in that you cannot threaten others.

    Your voting rights are regulated to only certain places and times.

    Your right to not incriminate yourself is regulated via Miranda.

    Congress has the right to define that you must go through a background check before you can purchase a gun. That does not "infringe" upon your 2A rights.

    Congress can regulate the militia but not the right of the people to bare arms. Having all citizens armed makes it possible to raise a well regulated militia. Remember you were expected to bring your own arms back then. Hey dont bring that cannon the enemy may not like it . Its not like we had a standing army and a large defense budget.

    Threatening others: Actual harm to actual people.

    Voting: You vote by district and we only have elections every so often. This is not a restriction its how it works.

    Miranda: Holds that if you volunteer information you have waived your 5th for that statement that YOU volunteered. Does not infringe on the 5th because YOU volunteered it. They cannot MAKE you say ANYTHING.

    Therefore: You may make laws against brandishing a firearm or threatening someone outside self defense, defense of property, or defense of others.

    Since firearm ownership is not done by district you may not restrict when and where purchases take place or how.

    And you can set up a system where people who CHOOSE TO VOLUNTEER the information may do so.

    Sure they do but we accept some. Basically my rights end where your nose begins. Its one thing to have congress write these regulations its another when unelected bureaucrats do it . It matters not who you vote for because these people dont leave. They continue to write the regs

    Though out history states that have really thought they could brush through their people have gotten around to doing it.

    It would be very difficult to get the the military to brush through Americans.

    The USG got smacked very hard the last time they did that - and that was against a lightly armed small isolated looney cult.

    They write the regulations based upon legislation passed by Congress.

    Freely . After they write them they should be sent back for approval.
