Zimmerman Case Is An Attack On Our Civil Rights

    One of the most fundamental rights we have, as Americans, is the presumption of innocence. The right to be presumed innocent until proven guilty. This doesn't just apply to court trials. It applies to arrests as well. Without the ability to show evidence of guilt, police and prosecutors are not supposed to charge anyone with a crime.

    But that's exactly what they've done in the Zimmerman case. After the Sanford Police and the state attorney both concluded there was insufficient evidence (if there was any at all) to arrest Zimmerman, the gutless coward Governor of Florida, Rick Scott, stepped in and appointed a special prosecutor for the sole purpose of having George Zimmerman arrested. This is mind boggling. This is directly contrary to the US Constitution, and the freedoms that thousands of US military men & women have sacrificed their lives for, for 237 years.

    And for what ? Just to pander to a mob of racist radicals led by Al Sharpton, Jesse Jackson, the New Black Panther Party, and the Trayvon Martin parents' PR man (posing as a lawyer), Benjamin Crump. Cowing to the threat of possible riots, jellyfish Scott has deprived Zimmerman of his constitutional protections, and in so doing, is really depriving every Floridian of the same thing. Now, it appears like, any one, or a group of us, could be arrested and thrown in jail, if Sharpton, Crump, and the rest of the race-carding bullies decide that's what they want, and go around demanding it.

    If Scott had a ounce of courage (and decency), he would have accepted the conclusion of the Sanford Police and the state attorney and allowed Zimmeramn to remain free. In addition, he would have called for the arrests of Sharpton and Jackson for inciting a riot and/or other charges. He would have ordered the arrests of the New Black Panther idiots for the bounty they proclaimed, decreeing a hit on George Zimmerman. Haven't organized crime bosses, et al, been arrested and convicted, and sent to prison for exactly the same thing ? That's all these Panther loonies are. A bunch of racist, violent criminals who should be locked up. Same thing with anyone threatening George Zimmerman and his family.

    What a pathetic specimen Scott is as a Governor. When the bad guys do things like this, the proper response for any public official is to take action against them. If they cause riots to occur, then you crush those riots with all the full force that is necesssary to do that. Police, riot gear, tear gas, billy clubs, National Guard, rifles, bullets and bayonets. After that, there won't be a riot problem any more. And all Americans will have all our civil rights we're supposed to have, unlike the current situation.

    Maybe Mr. "Cut Spending" anticipates a need for more prison $pace if the riots did occur. Could this be at the root of his spinelessness ? Maybe it's about time we got rid of Scott and all the anti-state income tax legislators, here in Florida, and get a firm handle on this whole crime situation.

    That doesn't make sense to me. Dead kid, guy who says he killed him ... this is not sufficient evidence?

    This post is ridiculous. It's a blatant example of what the OP is talking about, your post conveniently omits pretty much the entire context of the incident. The guy did admit to firing the shot which killed the kid, but he also said he did it in self defense because the kid was attacking him, slamming his head against the pavement, etc. There was not sufficient evidence to charge him with second degree murder, because the probable cause affidavit was weak and it was also based on false arguments--the result of either the prosecutor's deliberate omission of crucial evidence, or simply her incompetence. The OP is talking about how the convicted is innocent until proven guilty. Zimmerman has not been proven guilty and because of how weak the probable cause affidavit was, the case never should have gotten past a judge. The only possible reason for it getting through is political pressure being put on the prosecutor and the judicial system by the lynch mobs demanding "justice," which isn't actual justice, it's just the death of Zimmerman, even if he's innocent. There never was enough evidence to charge Zimmerman with second degree murder and there is certainly not enough evidence to convict him. That's what the OP is talking about.

    Sure. But you're also claiming that a dead kid lying on the ground and a man who admits he shot him isn't probable cause for arrest, whether he claims it was self-defense or not, and that's just completely insane.

    I'm not saying the guy is innocent, but lets face facts as to what has happened. Zimmerman claims self defense -- we have nothing solid to negate his claim that Trayvon was at minimum fighting back. He was an idiot, but even then, it's not illegal to be stupid. The man hasn't been tried, yet most likely he will live the rest of his life in hiding, if not in some sort of protective custody even if found not guilty in a trial. However, even a fair trial is not guarenteed here, as the worst kept secret is that there are radical elements ready to provoke riots if the "right verdict" isn't reached. It's coming, and I fear it's too late to do anything about it. Trayvon is already Saint Trayvon the Child Martyr of Skittles, and Zimmerman is the Racist Demon. That's the media story, and that's what's getting people ready to riot if Zim isn't found guilty.

    No that's not it. it's that you don't understand how our judicial system works. No one is EVER proven guilty of a crime at the time of arrest. That is what occurs in a trial. The Zimmerman arrest was completely correct. Not to make the arrest would have been wrong.
    If it makes you feel better (and it seems that it would), he'll probably walk because the prosecutor charged 2nd degree instead of manslaughter.

    I thought Zimmerman turned himself in?

    Anyways, the OP is right, only on the thing about the race-card was being over-played. We don't know what happened within those crucial moments that lead to Zimmerman's gun going off and killing Martin. Should Zimmerman of followed the kid? No, the kid wasn't doing anything more suspicious than walking down the street in a hooded sweater. The self-defense I don't agree with, I think Zimmerman provoked an attack, but as it cannot be proved otherwise at this moment, I will allow it to rest in my mind. I'll keep an eye out on CNN to see what happens next in the case, however. I think this is going to be one for the history books.

    Norm Wolfzinger has terrible track record for cases overturned on appeal and false convictions. He's a joke statewide.

    Not in Florida.. Manslaughter is lesser charge imbedded in Man 2.. Its up to the jury. Aggravated manslaughter.. meaning culpable negligence in the death of a minor.. with a firearem still looks like 25 years.

    I thought we'd gotten past the "salem witch trial" mentality. We haven't.
    I think he's been charged because of mob threats, AND that he was charged with murder2 because it cannot be proven.

    Murder 2 has a lesser charge imbedded in the statute in Fl. Manslaughter and aggravated manslaughter.. AM means the murder of a minor with a firearm..

    I don't claim to know about his guilt or innocence but to not have arrested would have been quite ridiculous. You have a dead body and a guy with the smoking gun. The Courts decide whether it was murder or self defence but that evidence alone is sufficient for an arrest.

    Thanks! Never lived in Florida so not familiar with the law there. In any case, it's obvious that a trial to take place.

    Good point! It is at least enough to say that the cause of death and circumstances SURROUNDING that death SHOULD be FULLY INVESTIGATED.

    I truly don't understand these people who IMAGINE that Zimmerman should somehow have been taken at HIS word alone. That is just plain STUPID thinking.

    Hyperbole aside... the Sanford Police sought charges, and categorized the incident as "homicide/negligent manslaughter" in their police report. Source: LA Times

    People use CARS to kill innocent people every day and they are not automatically arrested. Maybe the victim was at fault. Maybe the crash occurred because a dog ran onto the road. Killing someone does not in any way mean the cops must arrest you and charge you with some crime.

    In the circumstances, it does. Car accidents are all too common so it has to be seen whether it was just an accident or something more sinister. How often do people just accidentally shoot someone specially when they are not out hunting?

    Not really. The police exist in a very political environment. Remeber District Attorney Nifong. The police in Sanford are caught between the lynch mob and politiciasn who want the lynch mob to vote for them.

    The reason the state attorney refused to have Zimmerman arrested is because there was insufficient evidence for an arrest. If a window is broken, and you tell a cop you broke it, should that cop arrest you, right then and there with only that amount of information ? You think so ?
