In California from what I can see there is zero tolerance. I have a friend who is a big time tax lawyer. His daughter was a 23 year old teacher who made love to one of her 17 year old students. My friend's money and influence couldn't buy his daughter's way out of the problem. Today she is a registered sex offender and will be so classified for the remainder of her life.

Well, I'd say that's very different than 2 students who had a pre-existing relationship and one happened to cross the "I'm 18 now" finish-line before the other one. As a teacher, she was an authority figure, and probably should have had the book thrown at her. That's probably even worse than some random 40-something pervert.

At 23, she is legally able to purchase alcohol, where as an 18 y/o cannot. Once you can legally purchase alcohol, you enter a new era or responsibility in life.

Ah, sorry. I didn't realize that you actually wanted to adopt pre-existing relationships as the standard for legality. I thought you were just making a point about the fact that the date is arbitrary, and wanted a different arbitrary date instead. But if we were to adopt your suggestion, how exactly is one supposed to prove in court how long a high school relationship has been going on? What if the parents don't know about it? What if both teens lie? What if only one of them lies? Sending people to prison over what is essentially high school gossip about "who is seeing who" is too vague to make a legal standard. Plus, it would likely be discriminatory against the gays in a way that a distinct legal cutoff is not. Homos are less likely to be open about their relationship, and as such would have a more difficult time proving it in court.

My point is that this is not a case of a sexual predator. It's a person in a relationship who crossed the 18 year old finish line before the other person, and I think the authorities should have broad authority to take that into account. In fact, after talking to friends IN Florida who are social workers and deal with these types of situations frequently, they typically DO have discretion to deal with it outside a black and white interpretation of the law. Why this girl is getting the book thrown at her when dozens (if not hundreds) of others across the state are left alone is beyond me.

Obviously you don't

ped·o·phile (pd-fl, pd-)
n.
An adult who is sexually attracted to a child or children.

18 is a legal adult. 15 is a legal child. You like most liberals like to try and refine a word to fit the situation but the definition is quite clear.

What a ridiculous argument, worthy of a leftist. If it's your contention that the government definition of a thing is the actual definition of that thing, you will accept as marriage whatever government says it is, am I right? Or are government definitions of things only valid when it serves your argument?

Pedophiles are attracted to the physical characteristics of children. At the age of 15, a girl could look like an adult, or she could look like a child. We have no idea in this case what the "victim" looks like.

Are you incapable of reading a definition or are you just a good little liberal who thinks the definition can change with your mood?

If you are legally an adult at 18, its the same as being 40. What's hard to understand about that?

I am capable to discriminating between an actual definition and a government-mandated definition. Apparently, you believe whatever the government tells you to believe. If the government enacts a law declaring that the sky is orange, why, you'll be complaining about them there liberals who try to argue that the sky is blue!

What don't you understand about the term prepubertal that is found in the legal definition.

You didn't do anything other than prove my point. "Young children"= "prepubertal"

Pre-pub' is not someone 14 or 15.

How is there a difference? Is an adult an adult or not? Show me the laws that dispute this, not just petty opinions...

An 18 y/o adult and a 21 y/o adult are different. You are aware of this. The the law with regard to statutory rape is applied differently to a 40 y/o adult and an 18 y/o.

I am not sure what your attempted point is.

You provide a dictionary definition of pedophile- but then claim a 'legal definition of child:

But when I look up the legal definition of child- well it says you are wrong

child n. 1) a person's natural offspring. 2) a person 14 years and under. A "child" should be distinguished from a "minor" who is anyone under 18 in almost all states.

Or this definition:
2.Under the common law, a person who is under 14 years of age.

Appears to be a few definitions of 'child'.

Lets go to Pedophile- of which there is no 'legal definition'- it is considered a medical term actually.

By diagnostic criteria of the
Diagnostic and Statistical Manual of Mental Disorders,
Fourth Edition, a pedophile is an individual who fantasizes
about, is sexually aroused by, or experiences sexual urges
toward prepubescent children (generally <13 years) for a
period of at least 6 months

http://www.abusewatch.net/pedophiles.pdf

From Dictionary.com

Pedophile:

an adult who is sexually attracted to young children.

http://oxforddictionaries.com/definition/english/child

noun (plural children /ˈtʃɪldr(ə)n/) a young human being below the age of puberty or below the legal age of majority:

That is per the OED

Webster:
a : a young person especially between infancy and youth - and what does Webster define as 'youth'?

a : the time of life when one is young; especially : the period between childhood and maturity

To me the differentiation is important- because Pedophiles- who are attracted to pre-pubescent children act differently than those who are attracted to post-pubescent minors- and present a very different kind of threat.

At 18 years of age one can buy a Mossberg 500 pump action shotgun with a short barrel. It's wonderful for crowd control. That's as relevant as your analogy to alcohol. The law is the law.

I agree. . .but the law takes into account the circumstances. . .such as the difference in age AND in "authority."

There is NO comparison between this case of two young women having consentual sex and the abuse of authority, hypocrisy and pedophilia history in the Catholic Church.

In fact, in my time (I know. . .it's a long time ago!) the case of these two young women would have merely been considered "experimenting!"
