Multiple people informed him of the infeasibility (and illegality) of it, so somewhere in the next 6 days, it was decided that simply eradicating them was the only option left.
  
  
• The FBI said they could find no intent to break the law, therefore no recommendation of prosecution. This email proves, in plain language, that there was intention, and knowingly broke the law.

Anyone who knows anything about hacking knows that from what we publicly know right now, that the servers would serve no purpose in the investigation because the hack did not occur on the "server". Which IMHO is proven out by the fact that the FBI hasn't subpoenaed them

Everything publicly known right now says this was a phishing attack. And the fact that the FBI did NOT subpoena them pretty much bears that out.
