"Sex" is an activity, "gender" is a classification.

Is it? Is that a protected class under civil rights laws?

People get fired all the time for political opinions.

    Of course you would discriminate.

Would you hire a person so religious that he would comment on religion every day, would work God and his religion into every thing he does?

Would you hire a person who's religion or ethnicity required you allow him time during work hours to pray and require you to dedicate office space for him to pray wash (and only he could use these places), and he could not be exposed to certain food so all employees were banned from bringing in those foods?

Would you hire someone who was a transgender activist who was almost certain to sue you if one of your employees called him/her by the wrong pronoun, or objected to his/her bathroom choice?

    <>

Everyone discriminates every day. Who you sit next to, your friends, which checkout line you get in, where you eat, who you date and marry, people you avoid on the street.

Would you sit next to a person (not a cop) who legally carried a firearm? I doubt it, based on your anti-gun rants.

This idea that all discrimination has to be eliminated is foolish.

The claim that a person will never discriminate is equally foolish, and false.

The idea of keeping a good idea to yourself even though one person strong armies rarely ever make it to the top is over cellist , people care what you are instead of who you are, how much money you have, who you pray to and where you're from.
    Seems stupid to isolate yourself.

Look at it like a gene pool and the purer it is, the more chance you have of breeding with your cousin, the more diverse it is, the stronger it'll be.

I wouldn't discriminate against a customer. I'd have a great deal of difficulty not discriminating when it came to hiring an employee. If I had a small retail business that only required one or two people to assist me, the appearance and demeanor of each employee would play a big part in whether or not my business was a success or not.

I have a question, or rather an point. The decision could be a matter of preference and in order to make a decision based on preference or preferences, you have to discriminate. The word discriminate is an open word in which definition is based on application, like most adjectives, so although one person may deem the decision based on preference to be in line with the negative application of the word discrimination, this still does not change the fact the all decisions are based on discrimination. For instance, if a person prefers chocolate ice cream over strawberry ice cream, said person has made a decision on on his or her preference. I really do not like using terms such a discrimination to label something as good or bad because everyone's preferences are not identical. Also, the word could in the question denotes allowance, and there is nothing, absolutely nothing to prohibit a person from making decisions based upon preferences. Neither governmental policy nor employment policy can dictate what a person thinks nor their decision-making.

    Customers? no.
Hiring? job qualifications and a good rapport with a potential employee is most important.
I've always preferred working and socializing in a diverse environment. Its more energizing. Yes it sounds "snowflakishly" stupid but its true.

In the 1980's, I owned a video dating service. I strictly kept it as a HETEROSEXUAL dating service. No gays. Occasionally I would get calls from them wanting to use the service homosexually. I told them that was not allowed.

They sometimes said .> "That's discrimination". I replied "Yes it is" - and hung up.

No, and I guess. Sex is a biological classification, male, female, or abnormal (less than 1 percent of the population). Gender in the modern sense is a completely subjective construct and thus meaningless to any worthwhile discussion.

I guess it depends on what type of business you own, but you are excluding a lot of potentially excellent employees based on the above.

Weirdly enough, boobs in the case of hooters falls into the realm of merit. I discriminate based on merit.

Potentially excellent == completely crap in reality

If you're working a shop front/cafe then whatever the vibe of the place is it's suitable to hire inside that bracket.

For example I'm running a hippy cafe with organic vegan food I don't want a death metal addict working there or I'm running a death metal cafe dedicated cooking whole pigs and boiling their heads in a soup I don't need the vegan dude.
