The CFPB was found unconstitutional. Like some lenders they were as unethical and practiced strong arm tactics with no oversight.
The CFPB is by no means out of business. Richard Cordray is out and there will be changes and much more oversight. It should be of no surprise that E. Warren has objected to changes.

The number of supreme court judges as also changed since it was established with six judges. There have been as many as 10 during the civil war. The more judges added, the more conservative it becomes but if that's what congress wants, the number of judges can be changed.
