    All you see is what you want to see, so nothing would make sense to you.

    When Ramsey Bolton goads Jon Snow to come at him, it is different than Taras Bulba running from the Poles who chase him to be slaughtered, the former is get your opponent too angry to think straight and the latter is strategic retreat by making the enemy think they got you so they come out to play, the outcome is the same. Race is what you see everywhere, it could have just been two jerks meet and do what jerks do. The police don't have the luxury of knowing the perpetrators beforehand, nor do they know what tactics were deployed, they just see the damage done.

    That's not the issue, that fact you posted the fallcious statements in the first place. Yes reading is fundamental as in reading YOUR OWN CITE IN YOUR OWN OP and not misrepresenting what they say.

    And if he had any sense at all he would have let her call the police. Up until that time (when he slapped the phone out of her hand) he was in the right. He escalated it to physical by slapping the phone out of her hand.

    Perhaps but she assaulted him first by threatening to use her MACE on him, had she just got back in her car an left nothing would have happened.

    I agree. You missed my point though. He should never have started the physical altercation. That is the real escalation. He should have called the cops on her for the mace.

    He tried to take a picture, she threatened to MACE him. Who started the altercation? Should he have knocked the phone out of her hand in response? No. Should she have punched him? No. They both have their own faults in the matter.

    He did. She didn't have the mace out, so nothing was really done by her except running her mouth. Battery is not an appropriate response to a threat. He escalated it physically. Both deserve to be charged for being hotheads.

    So why didn't he slap the mace out of her hand instead of the phone? How do you react if someone slaps your phone out of your hand?

    from what I am seeing it sounds like both did wrong that night, but I will wait for more to come out

    if he was really drunk, I think that should be a crime to carry a gun while drunk

    neither sounds like the sharpest tool in the shed, arrest them both for any crimes they committed

    So if you make a mistake and drive the wrong way down the street and then get into a verbal shouting match and I slap your phone out of your hand, what is your response?
