    Just as the Islamic State (ISIS) claimed territory in Iraq and Syria, antifa militants have claimed territory in Seattle, Wash. According to reports on the ground from The Post Millennial’s Andy Ngo and Townhall’s Julio Rosas, protesters and antifa instigators have seized land in the Capitol Hill area around the Seattle Police East Precinct. Like ISIS, the rioters appear to have decided on setting up a government in their occupied territory, naming it “Free Capitol Hill.”

    “Seattle [Mayor Jenny Durkan] is allowing a dangerous situation to fester. [Antifa] militants have taken over & created an ‘autonomous zone’ in city w/their own rules. Police precinct abandoned. Antifa set up barricades to create a border. Calling for volunteers to provide armed guard,” Ngo tweeted.

    He, on his own authority, cannot order 3rd Infantry to march over to the WH, much less the NG.

    The president can take action independently if the there is a direct threat to the US or US citizens. He is required to notify congress and get their approval to continue. Certainly looting and rioting which has killed US citizens would qualify.

    I assume you have heard of the "suitcase". That is black briefcase which is always in his vicinity. It would allow him to launch nuclear weapons against a nuclear attack. Do you think he would have to wait for congressional approval?

    Good idea about steel cages. We'll build some after the reelection....... Oil costs too much, but yes, now that you mention it, antifa would make some LOVELY torches if the courts permit. Recycle. Compost. It's good for the Earth, don'tchaknow.

    He has been given authority already by Congress on nuclear weapons.

    You righties want a dictator but the rest of America is saying, "no, you don't get to do that."

    He has authority to use the military if there is a direct threat to the US or a US citizen. Whether or not he can order a particular unit is not relevant. He can order the Chief of Staff to take action to protect the US or US citizens when there is a direct threat.

    "The War Powers Act: As opposition to the Vietnam War grew, Congress passed a new law in 1973 to limit presidential power to launch the military into armed conflict. The War Powers Act became law after Congress overrode President Richard Nixon’s veto. It allows the president to use military force only with congressional approval or in response to a direct threat; requires the president to notify Congress within 48 hours of putting troops into hostilities; and limits such actions to 60 days without congressional approval, among other measures."

    Thank you for agreeing AND SHOWING that the Office of the Presidency has no individual power inherent in the office without FIRST BEING GIVEN AUTHORITY by the Congress.

    He has no INDEPENDENT COMMAND AUTHORITY at all without prior authorization.

    That the President HAS BEEN GIVEN AUTHORITY BY CONGRESS, FIRST.

    What do you think it means?

    The President can't give a private a lawful order without first having the authority to do so.

    That authority does not come from the Office of the Presidency.

    Lets go back to the beginning. That is a quote out of the war powers act which was enacted by congress in 1973. It says "or in response to a direct threat; requires the president to notify Congress within 48 hours of putting troops into hostilities; and limits such actions to 60 days without congressional approval, among other measures."

    Why would it say he has "to notify congress within 48 hours of putting troops into hostilities and limit such actions to 48 hours without congressional approval", if he has to get congress approval first? That makes absolutely no sense at all.

    How did this get around to giving a private an order? He goes through the JCS. Whether he could or would even want to give an order to a private is academic.

    It must be given to him by statute.

    The War Powers Act gives him authority to commit US forces if required to protect US interests or citizens. It is academic whether he could directly order individuals because that is not the way it works.

    He goes to the JCS and tells them what he wants. They will discuss it and give him options. Probably just gross numbers and a rough idea of what they would do. The JCS will then go out to the individual services and tell them what they need. The individual service would actually pick the units involved or they might even tell a subordinate unit what they want and they would pick a unit subordinate to them.. .

    For instance, the JCS might recommend a battalion force be deployed to a specific location. The JCS would then go to the Air Force and Army tell them they want a battalion of infantry to be deployed to a particular location within in a specific time. The Army would pick the battalion and Air Force would then pick an airlift unit.

    It probably would not come down to ordering an individual private until the battalion orders up the entire battalion. So I don't have a clue what you are talking about when you talk about Trump ordering a private to do anything.

    Not if the weapons were set to hit U.S. soil. The president protects the country from foreign attack. The governors protect the states from domestic attack.

    The military can refuse to carry out UNLAWFUL orders and I have no doubt that they will REFUSE if the Racist-in-Chief orders them to attack We the People exercising our Constitutional Rights.
