    It only has the right to remain in the womb if it doesn't absolutely need to remain in the womb to survive?

    What do you suggest? Once the mother is declared brain dead she is then also legally dead. Unfortunately what happens is the body still arts to fail so there is no way for a non viable foetus to survive

    I suggested viability may not be the best criteria to decide when the cut-off point should be.

    Of course it should. The point is made above, "fertilization to birth a fetus has increasing rights to survive". Viability increases its chances to survive.

    Those women who use abortion as birth control are few in number.

    And it is a fallacy.

    A) who the **** wants to use a more expensive and involved procedure?

    B) there is no evidence

    C) women who have repeat abortions do over thier entire fertile period. We are talking maybe two abortions in 25 years or more

    I think there is a moral tension between banning abortions and unrestricted abortions there must be a compromise and viability is what society agrees on. Individuals like you can disagree.

    Or does the woman lose rights?

    What you are not understanding is the woman would lose her rights but the fetal rights would probably remain the same. If the woman was 3 weeks pregnant pull the plug. If the fetus was viable keep her alive until a c-section could be performed and then pull the plug. It would be up to family wishes.
