The tip is not decided until after the service is provided, unless you pay up front, but the you are at Burger King and a tip is not generally given at fast food.
One would only have to worry about it if they frequented the establishment more than once. As in stiff the wait staff on visit A and visit B might give you food poisoning or worse. It's disgusting and appalling but that's the reality.

Waiting staff do a miserable, thankless job having to suffer whiny, rude, ignorant, demanding, arrogant and condescending dickheads, work unsociable hours and for little more than minimum wage-and let's not forget that there are slow times when they cannot rely on tips to make up their wages. I'd gladly pay more if I knew my waiter was getting a reasonable return for his/her work.

Why would there be any more tax? "Gratuities" and "Service Charges" will already be taxed because they're go to profit for the restaurant, not the staff and wait staff are taxed on the actual tips they get (sometimes even if they don't get them!). We'll only pay more where this system is being used as a means of criminal tax evasion (which is hardly a positive thing). I also don't see why eliminating nominally mandatory tipping will reduce service. Indeed, some of the evidence presented on this thread and those like it suggest that anyone who dares not to "tip", regardless of the quality of service, stands to receive criminally dangerous treatment if they go to the same restaurant again. A system where a tip is, as it once was, a bonus for service beyond the basic expectations would surely encourage quality staff to strive for that level while bad staff won't do anything different regardless (except maybe spit in fewer meals).
income tax. have you heard of it? right now, waitstaff is taxed on 11% of gross sales if you tip or not...because it's expected that you do...that's why i leave tips in cash even when paying with plastic.
