I want to create a large private city in middle america that can outright ban guns.

    The houses I have lived in said no (land) pets allowed, apartments no smoking, so no guns is no different. Most hotels ban guns. The court can say you violated contract, also since no gun stores will operate that would mean they left and brought guns in violating no guns across the state border law.

    The court is bound by the US constitution.
    No such law can exist under the US constitution.

    Meaning at any point the populace could vote to undo the nonsense being supported on the part of yourself.

    Well the members vote for the company government and the citizens vote for the state government, and the state government works under a constitution created by the private company and ratified under the first state government which is a puppet of the company. The first generation of the state supreme court would also be puppet judges.

    So yeah after 70 years (all supreme court judges will be 18 ) they can change things but by that point precedent will be very strong.

    I have no problem with your HOA on steroids idea. I do have a problem with you claiming it's a "state."

    the minute you open it to the public you have to go by the constitution, freedom of speech, freedom of religion, the right to bear arms... ect...

    some Atheists if I recall tried this in a town and you can't deny people rent, services, ect based on their religion

    I am claiming the land that if I manage to suceed in my business I would buy, would turn into a state when I get 1M members to move their and get control of ND legislature voting to split it in 2.

    How do you get Congress to go along with it?
    How do you get past the fact your new state is still limited by the US constitution?
    You know that when a state requires its people to agree to give up its guns as a condition of living there, it violates the constitution - right?

    It would be easy. I just guarentee what ever party is in power that our state will be predominately that party.
    Get congress to agree to specific exemptions like they did with Texas. If they approve the constitution of the state it becomes legal.
    Hope that democrats win all the presidencies and house elections for the forcible future, as they would refuse to enforce gun rights.

    It could be a state, but that is a very complicated process.

    If someone wants to carve out a state from within an existing state, the existing state must approve and allow it before anything can happen, then Congress must approve that separation and recognize that new state, and that is where the OP's dream would end, dead on arrival.

    The reason being, in order for a new state to be formed, Congress would have to approve it's charter and State Constitution and neither of those can be an infringement on the U.S. Constitution or the Bill of Rights.

    Book closed, OP goes home broke with no new state formed, hopefully the acreage was purchased very low and can be sold much higher in an attempt to recover some of the OP's loss'.

    Whether or not congress would approve the state constitution would be based on which party is in control, the democrats would approve the state constitution, and just pretend that guns were not prohibited. Republicans would be a bit more hesitant but with the promise of 2 rep senators they would jump to ratify it.
