    Presumably you would like the rule of law to apply to you, but would be happy to suspend it when it is inconvenient?

    Either the country functions under rule of law, or not. Two options. Which do you choose?

    In times of war national legislation, including criminality, is suspended. If it isn't, and democratic freedoms are freely given to aggressors, then they will undoubtedly win it. These aren't 'criminals', they're murder machines, and they declared war on us, not us on them. Am I really having to point that out?

    It doesn't sit well with me that a terrorist who says Kill Americans has any rights. The laws are what they are though.
    It doesn't change my distain for bleeding heart liberals that side with the enemy either.

    The US Constitution doesn't specify any suspension of rights for citizens at any time whatsoever. If she is a citizen, bring her back and try her for treason.

    The only thing she could be charged with is joining the enemy, and that will attract only a very minor sanction - if any sanction at all? As I've already mentioned, the US Constitution went onto the legislature (or whatever the legalese would be) long before anyone saw the Global Jihad coming; perhaps it's time to change it?

    Understood but I think there may be around 1,000 Terrorists. 1 un-American, 1 from the UK so far, about 150 French and a host of others that all have to be dealt with either by their respective countries or by some type of international tribunal. Some of the terrorists did renounce their citizenship and not all were from countries based on English common law.

    Good luck with that. But...be careful of what you wish for. One lousy worded sentence or phrase, then all of a sudden, the government can abuse the provision to strip the citizenship from anyone they want.

    So allow the enemy to continue having the upper hand then? I'm afraid we're fast reaching the stage in this war where doing nothing (as you suggest) isn't an option.

    He would, wouldn't he - to justify US withdrawal from the area and, as you say, bring them home. I'm afraid that along with other western leaders he profoundly underestimates the jihadists; they really are much smarter than we are.

    That's probably exactly what they did; but proving it in a court of law is the problem? The 'innocent until proven guilty' precept might have to be reversed for a while.

    How and where they are interrogated makes a difference. The FBI says they have no interest but they may have to get interested. If so, there are ways to get confessions or at least statements without torture. Once they have round one of questions they ask the same questions again. If they lie, that's a crime, etc, etc.
