It doesn't matter how many people are in prison if all of them are criminals. Instead of asking why so many people are in prison, perhaps we should be asking why and who is committing the murder in our country. If we didn't have that many people in prison, our murder rate would be even higher.

Why don't you read the Constitution? There is NOTHING in it prohibiting banning non-citizens entry into the USA or to remain in the USA.

The federal court rulings have been based upon a federal statute, not the Constitution.
