President needs a judge's OK to issue an EO

    Plans to phase out DACA were initiated by the Trump Administration on September 5, 2017, allowing Congress six months to pass the Dream Act, which would provide the path to citizenship for Dreamers under DACA that Congress had originally intended

    President Donald Trump is expected to announce on Tuesday that he’s ending the Deferred Action for Childhood Arrivals (DACA) program, which protects children of illegal immigrants from being deported.

    Trump is reportedly calling for a six-month delay in ending the program, which will give lawmakers time to pass legislation to address the approximately 800,000 people DACA covers.
    DACA is the previous administration's BS and was set to end in Sept 2017. Trump extended it 6 months to get the Democrats off their asses to pass immigration reform, the wall, and end senseless chain migration.

    So far the Dems have not acted so it might well be terminated by the SCOTUS when they reverse a district court's activist ruling. The Dems will either fix this with a deal or watch them processed and deported out of the country. It's just that simple.

    The latest 4th court of appeals denying the appeal again wandering outside of the four corners of the document will never stand up in the SCOTUS.

    It's just another delay like the terrorist country travel ban. If the Dems don't play ball, the SCOTUS will hand them their balls. :banana:

    Correction: Trump's travel ban was declared unconstitutional by a judge, but it is not unconstitutional, as ruled in part by SCOTUS.

    All forums online, are packed with "constitutional experts." /sarc However, they are all easy to dismiss. SCOTUS overturned one Obama Executive Order in 2014; Supreme Court rebukes Obama on recess appointments. While many of his EO's were being litigated, trump changed or removed them which made the cases moot and were subsequently dropped by the courts.

    Trump should ignore these judges and do as he pleases. How would these judges enforce their ruling? Hahaha!

    More specifically, it was declared unconstitutional by multiple district and appellate court judges, but allowed to remain in effect, temporarily, by the Supreme Court while they waited to review its constitutionality.

    But they have no legal right to the benefits incurred(IE: The right to stay in the country). It was a TEMPORARY injunction. It was written as such and understood as such. Only in light of Congress's inability to come to an agreement did they seek to make it permanent.

    This is the exact same case as the travel ban and Sally Yates's pouting. Exact same bullcrap. The executive has the authority to issue and rescind EO's, and the SCOTUS's reasoning(as well as Obama's), that immigration is under the helm of the executive also applies for this case too.


    What we're witnessing in the country right now is an attempt by Law Enforcement and judges to become a freaking Theocratic State If they succeed, kiss the country goodbye and you'll find it's a million times harder to get rid of a Theocratic State than a dictatorship.

    The matter landed within the jurisdiction of his court room for judgement so clearly the legality of his authority to rule on the case is only in question with those who don't like the way he ruled. I don't recall reading DOJ lawyers claiming the court is over stepping its authority.

    More Fake News. There's a bill being negotiated at the moment. It will either contain what Trump has asked for, or it will get vetoed. It's that simple. Do you not listen or watch the news?

    What's your point?
    EOs may be reviewed by the court but only after a plaintiff brings a case.
    No court has jurisdiction to review an EO before it is issued.
