It is illegal for an employer to hire an illegal immigrant. It is also illegal for an employer to discriminate based on concerns of a document provided during the hiring process. The employer is held responsible if they hire someone who has provided documents that are perceived to be valid.

It used to be you only had to get here. There was no illegal. You were an alien or a citizen.

 

There were laws on the books as early as as early 1800's regarding immigration but wasn't truly enforced federally until the US Immigration act of 1882 which federalized immigration due to worsening economic conditions due to unmitigated immigration. The Immigration act of 1882 was radically overhauled and became vastly more restrictive with the immigration act of 1924.
