UNESCO Passes Resolution Critical of Israeli Conduct in Jerusalem and Gaza

    This water source had been coveted since the enterprise of a homeland for Jews was conceived. Chaim Weizman, then head of the World Zionist Organisation and later Israel's first President, wrote British Prime Minister David Lloyd George in 1919, calling for the boundaries of the new Jewish national home to extend 25 miles north of the Litani river, inside Lebanon. Amongst other demands his letter asked that:

    "the water supply must mainly be derived from the slopes of Mount Hermon, from the headwaters of the Jordan and from the Litani river [of Lebanon]... [We] consider it essential that the Northern Frontier of Palestine should include the Valley of the Litani, for a distance of 25 miles above the bend..."

    But the mandate powers, France and Britain, would not redraw the map extending the borders of Palestine into South Lebanon. Between the months of March and June 1978, Israel's Operation Litani killed more than a thousand civilians, according to the records of local hospitals and the International Committee for the Red Cross. When Israel withdrew from its positions in June 1978, it handed self-imposed power to a client Lebanese militia in the South, led by Major Sa'ad Haddad.


    The same scenario had been envisaged 25 years earlier, by the fledgling Zionist state's leadership. In his published diary, Israeli Prime Minister Moshe Sharett quoted Army Chief of Staff, Moshe Dayan, who was to become Israel's Defence Minister, promoting the idea of an Israeli invasion and occupation of southern Lebanon up to the Litani River. It was a vision enthusiastically supported by General Dayan and David ben Gurion. Amongst the most telling things Dayan said, was that:



    "... the only thing that's necessary is to find an [Lebanese] officer, even just a Major. We should either win his heart or buy him with money, to make him agree to declare himself the saviour of the [Christian] Maronite population. Then the Israeli army will enter Lebanon, will occupy the necessary territory, and will create a Christian regime which will ally itself with Israel. The territory from the Litani southward will be totally annexed to Israel and everything will be all right."

    So much for intersts, now what about facts on the ground ? all the actions Nasser made a.k.a Casus Beli?
    BTW, you know what Dayan said about Jerusalem prior to 67 ? "I have no need for all this "Vatican"", that too changed and proves its not just about words but actions.

    Nasser had called for a summit to resolve the issue over the Straits of Tiran.. and most of the Egyptian army was deployed in Yemen.. Can you make excuses for the 3 hour attack on the USS Liberty as well?

    So he didnt mean nothing with all those speaches about destroying us, closing the strains was just to get attention and his army there was for Yemen, I guess he just had a very bad luck with us huh ?, King Hussein was also fooled and so was Syria, all Nasser wanted is PEACE with Israel but was too shy to ask, if we were that stupid we wouldnt exist today.

    This has NOTHING to do with Nazis. Why did you interject that and then accuse me?

    Oil tankers? No Israeli flagged ships had passed thru the Straits if Tiran for 14 months before the closure.

    According to Article 2 of the Fourth Geneva Convention that states that this convention will apply on territories that been taken away from High Contracting party" that controlled over it, and since no state did control Judea and Samaria (nor Gaza) in '67, hence the convention does not apply to such territories. Moreover, this convention and it's Article 49 does not apply since Article 49 was made to deal with the reality that was created in the World War II, as the official commentary of the Red Cross shows.

    Jordan controlled the West Bank and Egypt controlled Gaza in 1967.

    Moreover, the settlements are lawfully thanks to Article 80 of the UN Charter that protects the rights that were granted to the Jews over the Land of Israel by the document of the Mandate. One of those rights is to settle in the Land of Israel as Article 6 states.
    Now for showing that Article 49 of the 4th GC is no applicable for Judea and Samaria, the number one reasoning about the illegaly existance of Israeli settlements, we can read about it in Levy Report that stated the following:

    Now, if we wll cross it with the official comentary of the Red Cross for the Fourth Geneva Convention we will notice the following:
    So as you can read, from international law experts, till the actuall official commentary of the Fourth Geneva Convention are all say the same: Article 49 of the Fourth Geneva Convention was formed to deal with the practices was used in the world war II. Thus, has nothing to do with the reality in Judea and Samaria.

    Jordan controlled Judea and Samaria illegaly and without no recognition from the world. Even the League of Arabs threw it away of been a mamber of the League because of they illegal annaxetion.

    In March 1948, the British Cabinet had agreed that the civil and military authorities in Palestine should make no effort to oppose the setting up of a Jewish State or a move into Palestine from Transjordan.[17]

    The United States, together with the United Kingdom favored the annexation by Transjordan. The UK preferred to permit King Abdullah to annex the territory at the earliest date, while the United States prefered to wait until after the conclusion of the Palestine Conciliation Commission brokered negotiations.[18]

    Jordan formally annexed the West Bank on 24 April 1950, giving all residents automatic Jordanian citizenship. West Bank residents had already received the right to claim Jordanian citizenship in December 1949.

    Jordan's annexation was widely regarded as illegal and void by the Arab League and others. Elihu Lauterpacht described it as a move that "entirely lacked legal justification."[19]

    The annexation formed part of Jordan’s "Greater Syria Plan" expansionist policy,[20] and in response, Saudi Arabia, Lebanon and Syria joined Egypt in demanding Jordan’s expulsion from the Arab League.[21][22]

    A motion to expel Jordan from the League was prevented by the dissenting votes of Yemen and Iraq.[23] On 12 June 1950, the Arab League declared the annexation was a temporary, practical measure and that Jordan was holding the territory as a “trustee” pending a future settlement.

    Only Britain and Pakistan acknowladged the annaxetion, and yet the nations of the world did not recognzie it. You did not contradict my claim.

    Sure they did.. Jordan managed the West Bank very well for over 17 years and during that time they were recognized as inhabited by Palestinians and managed by Jordan.. I used to fly into Amman all the time.

    The annaxetion was illegaly. There was no international recognition by the nations of the world for the control of Jordan over Judea and Samaria. Moreover, such control only hurt Jordan when they was kicked out of the League of Arabs. You are not contradicting my claim.

    And I used yo fly to Greece, and....?

    all the experts in international law at the United Nations Security Council, the US State Department, the Israeli Supreme Court, and the International Court of Justice say that the West Bank is under the authority of the 4th Geneva Conventions and the 1907 Hague Regulations, since it is officially Occupied Territory and Israel is the official Occupying Power.

    She did. Right after she annexed illegaly Judea and Samaria. 5 out of the 7 mambers of the League of Arabs in voted, after the illegal annaxetion of Jordan, in favor of expelling jordan out of this organization. The five states were Saudi Arabia, Egypt, Iraq, Lebanon and Syria.

    They are all been contridacted by the official Commantery of the Red Cross of Fourth Geneva Convention + they are been contradicted by Article 2 of the convention.
