It’s a good argument Margot except it may not apply in this case. In Pickering the teacher was not contractually bound whereas Omarosa might be depending on the language of the contract she signed. The First Amendment also doesn’t apply because by signing such a contract she waives her protected right in this specific instance. It’s much like in a typical NDA (non-disclosure agreement) one can be sued for disclosing whatever was prohibited by the agreement.

She shouldn't be sued. She should be in jail.

There wasn't a non-disclosure in the Pickering case.

Unless she voluntarily gives up that right by signing a non-disclosure, which she did

Its bluster and buffoonery by Trump. He can't afford this to go to court because the whole NDA business could be overturned when the court rules they are unlawful because of inequity in favor of the party seeking secrecy. There is no reward to the party being silenced commensurate with the penalties.

It won't go to court because Trump would open a Pandora's box if he lost.

It's not that simple. Contract law, equity, and secrecy provisions of law apply:

Trump won't go to court because a loss will expose all his NDAs to breach. There is no doubt he will lose.

Hope Omarosa got a Yuge advance on the book, she's going to need it for legal fees.

I watched around 24 news clips of Omarosa praising Donald Trump.

Pretty sure there will be more that will be shown in court when Trump sues Omarosa.

Just another employee who was butt hurt for being fired and goes postal.

I'm more curious what federal laws were broken when Omarosa sneaked an electronic recording device into the White House Situation Room ?

The White House Situation Room is suppose to be the most secured room in the entire White House ?

Who knows what else Omrosa recorded in the White House using her phone and if her phone was compromised by the Chi-Coms or Russia Russia Russia ?

lAUGH IT UP. Trump looks like a ditz. Omarosa has tapes. Trump will be drug thru the mud, and the NDAs are UNENFORCEABLE.

Trump won't take the NDA issue to court because he would lose and then be blow-torched by others with NDAs.

If she broke any security laws, that would be the main focus of Trump's whining. He wouldn't even consider taking the NDA rout.

So government employees can disclose anything they want as part of the 1st A? We'll see what the wire tapping laws are in the places she recorded conversations.

You think she tapped into wires to make those recordings?

Then why is Trump-0 concentrating on the NDA angle instead of any civil laws you think she might have broken? I realize that Trump's lawyers are idiots, but a first year law student would know to do that if those rules were actually broken.

DC Wiretapping Law. The District of Columbia's wiretapping law is a "one-party consent" law. DC makes it a crime to record a phone call or conversation unless one party to the conversation consents. See D.C. Code § 23-542.

I would imagine that in DC one party laws apply. That's why I mentioned if she did it in other places too. If she did it in PA it's illegal. PA is a two party state.
