In the 1935 Department of Justice appropriation, Congress officially recognized the Division as the Federal Bureau of Investigation, the FBI. No...he asked Pence personally the night before the rally, according to the new Woodward/Costa book and he asked the crowd, at his rally, on January 6th, to go to the Capitol and demand that Pence break the law. It's in his speech...stating that election "fraud" allowed "new rules." IOW, he was making a call that wasn't his to make - i.e. fraud - and that that allowed Pence to disregard the existing Constitutional and statute law...and play by "new rules." IF it can be shown that he was aware of the Oath Keeper plot to break into the Capitol Building, he becomes a co-conspirator at sedition. I believe that evidence will be found, not by Congress, but by the DoJ and that he'll be indicted and tried.
