They would have a far better case to defend Baldwin had he killed an actor during a gun battle scene.
It seems totally ridiculous he would point his own gun at a camera person. I call it his gun since he is the producer.

Baldwin never made Trump bad. Baldwin is an actor.

Every (real) weapons trainer requires all actors to verify their rounds in the chamber. That way there is no liability against them.
The fact that Baldwin already had two previous live round accidents just 5 days prior, coupled with not only hiring, but keeping the weapons hacks they had on set after the first accident, and not checking his own weapon, makes him liable.

 

Declare today..... What did Baldwin do wrong?
I can think of a number of things he did wrong.
1. Gunning down a woman in charge of cameras.
2. Gunning down a director on set.
3. Shooting a loaded pistol when the only right thing to do was carefully inspect it completely.

I simply never fire any gun that I have not first completely inspected.

Obviously, the Civil Case will involve any actionable party.
Up to and including Baldwin, the person in control of the set on that day, anybody on the crew who was involved in the chain of custody before Baldwin got the weapon, and the Production Company.

According to an affidavit obtained by USA TODAY, several crew members handled the firearm before it was handed to Baldwin and deemed a "cold gun," or a weapon without live ammo that was safe to use.

"Assuming it was just incompetence or a colossal mistake, that rises to the level of criminal negligence, which would be sufficient for a manslaughter prosecution," Rahmani says. He added that if charges are brought, the person who loaded the gun could be prosecuted, as well as anyone who knew the gun contained live ammo
