I have seen police use this technique on more than one occasion. I think the problem here was the continuation. Typically, you will see it as a momentary tactic to maintain control, while freeing up a hand(s) for whatever reason (ex. application of cuffs). Where this guy went off the rails is the suspect was restrained and controlled, and he just sat there for minutes with his knee on the neck. Hell, he had his hands in his pockets for a while. I don't think he meant to kill him. I don't think 2nd degree murder is the right charge. The code for 3rd degree seems to fit this like a glove. Interestingly enough, I was talking to a close friend who is L.E.O., and I told him I couldn't figure out why he died. The knee was not on the trachea, and even if it was on a carotid, a person has two, and people live long and uneventful lives with one of them being blocked. My initial thought was some form of positional asphyxiation. Or some medical condition exacerbated by the exertion of the arrest and the knee in the neck.
They need to do a better job of risk assessment. These are trained professionals. In that specific video they yelled a command to "go inside", and within 2 second yelled: "LIGHT EM UP". They opened fire with non-lethal rounds, but did not even give the citizens, whom were sitting on their own property, not in the streets, time to react to the command. I understand that the police need to protect themselves. They are people too. But we see in video after video the police abusing their power. The worst one was the 80 YO man who was standing on a sidewalk all by himself then 2 policeman with shield yell at him and another man to move. The older gentleman had a cane and started to walk away, but the officer for some reason didn't like that so he pushed him from behind with his shield and knocked him down. Look, I think anyone who loots, or is violent in any way deserves what they get. But those who are peacefully walking or riding and not looting should be left to peaceably gather. Thats actually in the constitution. And their are countless videos of the police doing exactly what the protestors are there to protest.
I would say Minnesota's 3rd Degree Murder statute fits it perfectly. And now, due to external pressure, they have ramped it up to 2nd degree, which does not make any sense.
