If that's the standard, there are many people in prison on double murder charges that may be looking at drastically reduced sentences. If a fetus isnt a human, you shouldnt be able to charge someone that kills a pregnant woman, or causes her to lose the baby, with a crime against the fetus.

No I'm father to that child in the womb, I can watch him on an unltrasound, see him react to my voice, feel him kick his mamma. I became the father of that new human life the moment it was created.
