Checks and balance should observed by the three branches of the government, the three branches are to serve the people and not themselves and non should be above the people with the current kind of governance that we do have, therefore non of the three overpowers the others.

I actually read something about that possibility this morning. The Senate may argue that the articles do not meet Constitutional definitions of impeachable and send them to the SCOTUS first.

 

Noah Feldman, Harvard law professor and democrat who testified before the house judiciary committee in the impeachment hearings, says that if the articles are not transmitted to the senate there is no impeachment.

Impeachment has not yet happened.

And I haven't the slightest idea why this text turned green.
