    When your laying on your back being pummeled to death your logical reasoning skills aren't up to 100% the fact that Zimmerman thought Trayvon reached for his gun doesn't mean he actually did but may have waved his hands around his stomach area with no idea that the gun was there. Or then it could be Z was right. Or it could be his assumption due to paranoia that it is what Trayvon was reaching for. However, whether Trayvon touched the gun or not is immaterial.

    Z was observing Trayvon from a distance not stalking him. I observe people all of the time, it doesn't give them the right to attack me.

    It means that the Judge will instruct the Jury as she is required to do by Statute. If not, she has created a basis for a mistrial.

    This will be discussed Friday AM if you watch a video feed with commentary. Or maybe HLN, or whoever carries it. The Prosecution will move for a dismissal completely, or just of the M2, etc.

    What's the f'ing hurry. You are like the 8th person that I have made the effort for. You are not a bad poster, but that crap will get you on my Ignore list.

    I know why you aren't a lawyer.

    This is an analysis by a real lawyer. He thinks that Z will walk on the murder 2 charge. He also thinks that the State can prove a manslaughter charge but that Z can still walk if the State can't demolish the self-defense claim. Notice what he says about the charges.

    It still depends on jury instruction and the court may not include manslaughter. This is not a capital offense where a lesser offense instruction is required.

    So are you claiming that TM ran toward Z and attacked him?

    The reality is that Z cleverly stalked TM and ambushed him. He grabbed his jacket and shot him dead. He then proceeded to inflict superficial wounds on himself so that he could get away with murder.

    the state is desperate, no doubt. it seems their strategy has been to put on what little they can grasp hoping that sybrina's emotional performance will make the jury feel so sorry for her that they convict purely on emotion. i really don't care what the jury finds. i haven't seen anything yet that proves george is guilty and did not fire out of self defense. there is no way i would vote him guilty.

    Friday AM, once they get thugmom off the stand, it'll be fun to watch O'Mara motion for dismissal. He will make a case to the Judge that the Prosecution did not prove what they alleged in Opening. The stooge Judge will hem and haw, but won't grant it. But it will be fun to watch regardless.

    The jury is weighing-in on what versions of Zimmys stories the state needs to prove beyond reasonable doubt ... that's why they're waiting for the defense to make it's case.

    The only thing they have to weigh is whether they would reasonably think they were in imminent danger of grievous bodily harm if they were in the same situation. So far the prosecution has only helped the defense.

    Zimmerman's words (12:12 mark):

    "So I tried to squirm off the concrete.
    So when I did that, somebody here opened the door (John Good).
    Then I said help me, help me.
    Then he said I will call 911.
    I said no, help me, I need help and I don't know what they did.
    That when my jacket moved up and I had my side arm, my firearm on my right side hip.
    My jacket moved up and he saw it, well I feel like he saw it.
    Then he said 'You are going to die tonight motherf**ker.'
    Then he reached for it, well I felt like he reached for it cause I felt his arm go down my side.
    Then I grabbed it, I grabbed my sidearm and I shot him."



    As you see, he never stated he was screaming for help, he say he saw John Good and asked for help securing Martin. You should also notice his statement indicates he was in control at the time. Read the words.

    John Good "It seemed like a tussle, they were vertical to me just like the blinds in my window were.
    Then at one point, I yelled out, 'What's going on and stop it I believe."

    Prosecuter: How long did you have one foot out. Was it seconds, was it minutes.

    John Good: "Seconds."

    Prosecuter: Ask about being more specific

    John Good: "A few seconds."

    At 11:31
    Prosecuter: Could you tell if it was one or two people upon stepping out?

    John Good: "I couldn't tell at that time "

    13:18 mark
    John Good on the shifting movement: "It was quick, as I said I only seen at most 10 seconds of everything." It could be as little as 2 or 3 seconds.


    15:11 mark
    John Good on why he felt it was serious: "Because it looks like strikes being thrown or punches being thrown. But as I clarified, due to the lighting (conditions). It could also be holding down but there were arm movement gong downward."

    15:50
    Could John Good see that person's hands: "No, just appendages."

    17:11
    Prosecuter: "What do you recall saying?"

    John Good: "At first it was what's going on and no one answered."
    "The person on the bottom, I could finally see, they yelled help."
    "Then at some point I yelled cut it out, then a yelled I'm going to call 911 when I thought it was getting really serious."


    As you see, Zimmerman and Good both point to a time when Zimmerman asked for help during the 2-8 seconds Good stepped out the door.
    If he is that calm and precise about when he was asked for help, would he have stated he was constantly yelling for help
    Zimmerman's defense team likes to walk through a made up story but as you see in Good's first statements, his MMA style statement would actually have to be false information as he clearly states he did not see any punches..

    Explain please the fact that an eye witness testified in court to having seen the darker skinned man, with a dark sweatshirt on top of the lighter skinned man with the lighter jacket and that the dark skinned guy had his arms flailing over the bottom guy? Explain Zimmerman's blood all over Trayvon's clothing? There is absolutely nothing of evidence to the contrary of Zimmerman's story. This deal is over.

    regarding any lessor charge.
    Totally up to the Judge.
    That is all I'm asking confirmation on.
    At this point ... NO ONE Knows.Not even the Judge.

    Certainly heard where the Captain said that in imperfect defense stated where you could still claim self defense even though you might have been the first one to push but I forget you are not watching what everyone else is watching.

    I am not saying you would lose, but it is up to the court to include a lesser defense or not. It could go either way.
