    excessive force, the fetus never did anything to the shooter

    had they charged her with assault or something, fine, if she did those things

    we are not talking about anything other then her murdering someone... which she did not

    She caused the death of her unborn child.. Simple.. You want to rant about abortion...

    Two victims the woman assaulted and the unborn child and you want a pity party for the assaulter.

    never said that, I said the women shoudl not be charged with murder - self defense is also a valid defense to shoot someone

    your confusing the issues here, that is what happens when you over charge someone, she is not guilty of murder, but could still be guilty of assault and the other women could claim self defense - all can be true at the same time

    this was a crime of passion, they were fighting over the father of the child

    She is not being charged with murder. She (the pregnant lady) is being charged with manslaughter....2 completely different charges and classifications. However, I have little doubt it will be reduced to Criminal Negligent, which is a Class A misdemeanor in Alabama.

    And you seem to be confusing what actual charges we filed. She was not charged with murder. Manslaughter accounts for "crimes of passion".

    it's still a murder charge, just a lower degree of homicide and still just as wrong

    oh I agree, it's an overcharge and either the jury will exonerate her or a plea bargain will be had as there is no way she is guilty of it

    Manslaughter is not a murder charge. Maybe that is the issue, your lack of understanding of the legal difference between the two. Manslaughter is legally applied when the crime does not reach the level of murder....which this case does not. Some States have even lessor levels of manslaughter, such as Criminal Negligence or Reckless Endangerment. However, other States group Criminal Negligence and Reckless Endangerment under a manslaughter definition.

    It appears that Alabama has 3 levels when there is a loss of life:



    I would say the pregnant lady definitely qualifies under Manslaughter or Criminal Negligence.

    Apparently it was self-defense. The pregnant woman started the fight and refused to stop the fight endangering her child and her actions resulted in the child's death, manslaughter.

    My point being they charged and lost so they are seeking another person to blame. It’s a terrible precedent to set

    Wasn't she in her car and leaving the scene when shot? The threat was over if this was the case and using a gun to win the argument when it was over is questionable, yes?

    Well, it was certainly the actions of someone as to why this unborn child was lost. From my understanding, there were only 2 people involved and could be considered as being the responsible party......one of those was determined to have acted in self-defense by a Grand Jury. That leaves only one other person as being responsible.

    Well Grand Jury does not investigate. The police do. In their investigation they found the shooter responsible, hence the charges. Not sure that the prosecutor will ever win this case on that fact alone.

    I think you might be thinking of a different case. Everything I have read states it was outside of a Dollar Stare and there is no mention of anybody driving away. She was shot in the stomach and that would be hard if someone was driving away. Also, the other girl was deemed to have acted in self-defense by a Grand Jury.

    No, but they do base their judgement on the evidence presented. Prosecutors quite often send case to a Grand Jury. That is the exact purpose of a Grand Jury....to determine if a law has been broken.....or if there is enough evidence to forward the case to a criminal court.

    I understand, but if the woman was leaving the store there would be no need for gun violence over an argument, and she was pregnant.

    Her actions caused the death of the child. If I am driving my car with my child in the backseat and I reckless drive and crash the car and the child is killed I can be charged with manslaughter although I had no intention of killing the child and did not directly kill the child.

    "Manslaughter is an unlawful killing that doesn’t involve malice aforethought—intent to seriously harm or kill, or extreme, reckless disregard for life. "
