PA Court Rules 2020 Election Likely Unconstitutional

Funny part is if they don’t certify by November 30 there is no Pennsylvania state legislature in the house and only half of the state Senate.

Essentially, PA's state constitution requires that any constitutional amendment (in this case to change voting laws) be passed by legislative vote in two separate sessions, then be published as a public notice, then voted on by citizens to ratify any changes.

Act 77, to expand absentee voting to a "no excuse necessary" vote-by-mail, passed one session. It had not passed a 2nd session, no public notice was given, and citizens did not vote for the change.

Therefore, the legitimate voting laws require that absentee voters have one of four legitimate reasons they cannot vote in person in order to qualify to vote by mail.

Governor Wolf and the Sec. of State Boockvar went forward with no excuse mail-in voting before the voting laws were officially changed. All those mail-in ballots are therefore not qualified votes under the current PA constitution.

Relief sought is to either 1) not count unqualified mail-in ballots (which could be over a million of votes) or to have the legislature appoint electors as they see fit.

Essentially, Gov. Wolf ran a constitutionally illegal election. He ought to resign.

 

The argument is not without precedent in PA.

 

If the judge goes by the rule of law, they have to void the non-qualified mail-in ballots. If they go by mob rules, then the votes will stand.

Citizens should bring a class-action lawsuit against Gov Wolf and the Sec. of State. They are the ones who created this illegal mess.

The mayor of Houston, TX almost created a similar fiasco. At some point shortly before the election he said he was going to mail out ballots to all registered voters in Harris County. Our governor stopped him because Texas state laws also require an excuse to vote absentee. We would have had millions of illegal votes just from Houston if that hadn't been stopped before it happened.

Then they should have brought this suit months ago prior to the election. I think there was a deadline to do that which long since passed

 

Wolf's term of office doesn't end until January 2023. He should be recalled or impeached...or whatever legal remedy there is to get him out. This is a travesty he committed against the citizenry of PA.

 

The current law is the current law, and it only allows mail-in voting for a limited number of excuses. It matters not if the suits are being filed after the election. The law does not change.

I disagree. Biden is President elect. No matter how loud and long Trump and his clan yell to the sky fraaaaauuuddd, none of that changes the facts that Biden will be sworn in come January.

 

The PA legislature has entered a resolution for the AG to decertify and return the constitutional power of certification to the legislature.

 

Biden is not president elect until the electors vote. Simple legal fact.

Good for you. If he does I will celebrate with "#resist" and "#impeach" since all it takes now to impeach a president is a majority in the House which we will probably get because the incumbent almost always (except for 1982 and 2020) loses seats. It will be fun.
