Why is having sex with a drunk woman considered rape?

    not really. it's just that a ridiculous double standard has cropped up in the last 4 or 5 years. People have been getting drunk and making bad decisions (men and women) since the invention of alcohol. But now it falls upon the man to administer field sobriety tests, to determine if his willing partner actually is willing. No such standard exists for women.

    I am inclined to agree that sex with a woman who is highly drunk and totally out of it can't be consensual, and is rape if done by someone who isn't drunk. A man can also be so drunk he is totally out of it, so even if he is sustaining an erection, and even though he is wanting it, that is rape. So if a very drunk man hits on you, and you agree to have sex, then you are raping him. If a totally drunk man hits on a totally drunk woman, and they are both just out of it, and totally enjoying having sex together, and they are both doing sex acts to each other, then they are kind of raping each other.

    The issue is that the man could just be claiming to be drunk, and there'd be no way to know, and there'd be a very blurry line between just a few drinks and drunk anyways.
    So in reality there'd be no way to criminalize it unless (1) you criminalize all sex while under the influence of alcohol, (2) we develop futuristic mind-reading technology to see what that person's actual intent was in the situation, or (3) you apply a law against males that doesn't apply to females. (all three of these would have a lot of issues, which I don't think are worth going into here)

    I think that most rape cases are very difficult to prove and unfortunately, thats just the way it is. The best thing we can practically do is teach men to respect women and consent, and to teach women not to put themselves in dangerous situations and to be able to handle rape situations the best they can to avoid it.

    That is pure propaganda l,that is not what prop 57 is about. The proof is where the proposition is releasing prisoners early for nonviolent crimes and yet the examples are violent crimes so you know this is bullshit

    Why is there a double standard? It is men who usually do the raping. It’s mint or raped by women why don’t they report it?

    Whenever something plain and simple is verbose and obtuse, bureaucratese and legalese rather than English, you know that it's full of lies and corruption, and they're going to use all those words to either not give you something they said everybody was going to get, or to take something from you that you didn't realize would be taken by reading the ballot initiative.

    The problem here is that the principle being discussed is that a person who is drunk is not providing informed consent, because they don't realize what they are consenting to. So if a sober person convinces a drunk person to have sex, it's considered non consentual. The word "no" may never have come into play.

    I believe that you tried to ask, if men are raped by women why don't they report it?

    Part of the answer is that they might not consider it rape, just as many women don't consider it rape. Mind you that is in their own viewpoint of their own specific situation.

    However, the other part of the answer is that men are more often dismissed are claims of being raped, especially by women, than women are. While the female victim incident rate is higher, the male victim under reporting rate is higher. Claims such as he must have liked it otherwise he wouldn't have had an erection, are common dismissal of a male victim claim. The ridicule he receives by other men is also a factor.

    In many states it only specifies undesired penetration. There is no distinction that the victim is the one penetrared. Forcing him to penetrate her is as much rape as her anally penetrating him. Also note that the penis is not required for that legal definition. It allows for attackers who penetrate their victim with any object.

    Prop 57 was about making California safer so the Democrats told everyone.

    2/3 of low information voters believed the lie.

    Less time in prison means early release from prison and back into the neighborhoods until being caught again for another crime.

    cause everyone would blame the man for getting drunk, they would never accuse the women of raping him, she would just say he wanted to have sex, so she had sex with him.... my guess, drunk sex has been a thing sense alcohol was discovered

    exactly, be like saying a women can't get wet unless she wanted it... neither is true

    what is true is if you get drunk, male or female, you may have sex with someone you may of not had sex with if you had been sober - lol, so lesson to be learned... do not get so drunk you have sex with people you would not of wanted to have sex with

    The California DMV got caught registering non citizens to vote but CNN said nothing and neither the California Attorney General or 3/4 of the state legislature plan to do anything about it.

    A lot of ignorant people think guys can't 'get it up' when they're drunk, so they automatically assume any guy who has sex is sober and lying about being drunk.

    Mostly unattractive women who've heard too many excuses for rejection.

    MS-13 turf are only found in cities run by Democrats.

    MS-13 do cross the lines and rape, murder, and commit crimes outside their turf and have no protection from ICE in cities run by Republicans and don't have sanctuary protections for illegal alien criminals.
