    He wasn't in the house. He was outside the house. And it depends if your state has Castle Doctrine or not. Some states you have a duty to retreat.

    It seems whenever these situations happen it comes down to the suspect not following police orders. The defenders will claim he is not arm or does not pose a threat and the police supporters will say he didn't follow orders.

    1. Would the police supporters support a law that say police can just shoot anyone that does not follow there commands? If not all commands which command violations can police shoot people for?
    2. Would the anti police shooting group want a law that says police can never shoot an individual unless they know 100% that they are armed or pose a threat. If not 100% put in your own threshold.

    Don't just think about your answer in terms on just this situation. Consider some of the other more recent shootings. I often think about the shooting of the person in the hotel when a officer was commanding the suspect when he was on the ground.

    They only do it in heavily left areas, they don’t try it anywhere that’s right wing leaning. They really don’t try it in areas with lax firearms laws. They only seem to strike the place where their own supporters live.

    Why was he breaking into cars and running from the popo.......my parents taught me not to do those things.......and no cop has ever felt the need to shoot at me.....

    I don't think I'd be "cool" with being shot for any reason.

    But therein again I also don't go hopping fences at night trying to enter my own home through a window in pitch black backyard all while being fully away of the fact that police cars, officers, and helicopters are in the area doing something.

    It just wouldn't happen to me.

    But now let me ask you something.

    Pretend you're a police officer.

    You get sent on a call because somebody spotted a guy that was reportedly breaking into homes via their backyard windows, you're aware that this has been happening in that area frequently and you get a description of the guy.

    On route you are told by the pilot of an overhead police helicopter that a man fitting the description is hopping fences and moving from backyard to backyard.

    You converge on the location you're directed to, looking for a guy fitting the description you were given.

    You find said guy, matching the description, attempting to enter a home through a backyard window.

    He has something in his hand.

    It looks like a gun.

    Do you wait to see what it is?

    Do you gamble with your life like that?

    That's my question for you (any anyone else that cares to answer).

    I imagine it would be much like being a actor. An unpaid actor.

    You rock up to an event. The bloke in the shades says "game face on, Superior Promotions Inc. only gives you one chance", they take a breath and compose themselves then run in the lecture hall screaming, blowing air horns, and striking perfectly composed dance moves.

    They're post-structuralists, maybe they're postmodern artists and this is all a performance piece. It's the professionally(literally) oppressed's version of graffiti. They've just changed your wall for your lecture hall. As we gave graffiti artists places in cities to express themselves legally graffiti in illegal areas declined, maybe we can give these postmodernist artists some free time in a lecture hall to stage their performances and that will stop them from ruining meetings and talks.

    Of course you have. How easy it is to catch up to a fleeing criminal and recognize the dark object in his hand is not a gun since there is so much time to examine the item. Maybe they just need an expert like you to stand in front of them and tell them which is which.

    Yeah, they were sure. The chopper had him the whole time on IR. IMHO the problem here was that this was a property crime with nobody hurt. He wasn't going anywhere with the chopper overhead. He was going to ground and a K9 crew would have solved the problem. 20 shots is a lot but with a night time shoot at distance this is what their training would have dictated.

    Did the police know he was unarmed yes or no? I asked first.

    And if you are a fleeing criminal and you refuse to obey commands and you have something in your hand and you start to point it at them that can be reasonable suspicion you are armed and ready to use it.

    So everyone including you is harping that he was unarmed...........did the police know that he was unarmed?

    The two aren't dependent upon each other.

    "Show us your hands" is a command meant to subdue you.

    Complying with that command means presenting hands in forward view in what is a non-threatening position.

    Not complying with that command doesn't mean they cant see what you have or that you're reaching for something.

    You could have a gun in your hand and you're trying to hide it from their sight, or you could be reaching for a gun, and they cops could see it and do the "gun gun gun" reaction.

    C'mon, fully think this through.

    Ask any policeman... under many circumstances, when a 'perp' has deliberately ignored a lawful police order, the likelihood is strong that he will try to pull some kind of crap -- including brandishing a gun! Also, in many situations, it can be very damned hard to tell exactly what a person is holding in his hands -- especially if that person has deliberately obeyed a police command!

    And, many perps are so 'amped-up' on drugs when the police have to deal with them that the cops must use so-called "excessive force" just to get them down and harmless -- especially if there's visual evidence that a perp is brandishing a gun in his hands.

    I've said it a dozen times, and I'll say it again -- when the police tell you to do something -- DO IT! Nothing less, and, nothing more!
