Um, the one from 2009 is linked to in one of the sources and references the one in 1952, with the same findings.

Oh, and the 3rd link I gave you isn't dead.

No, it's an awful case. I think we will know, and don't think this is going away, as this teacher's taped comments in the classroom about why kiddie porn should be legal have come out too. Go ahead and tell us why a teacher should be discussing kiddie porn in any secondary school classroom, and how that's another exercise of free speech. School boards have a rational interest in regulating teacher speech in the classroom because teachers are speaking for the school board when they teach, and without such regulations, teachers could utterly ignore a curriculum with no consequence.

Without going into detail, there is a two-pronged test, the chances of the anti-military comments passing the first prong are about 50/50 IMO, of passing the second prong? 90% against. The other 10% is a California moonbat factor. The chances of the kiddie porn comments passing either prong are negligible no matter how batty the jurisdiction or judge.

I've posted the applicable law and regulations, are you going to find some actual grounds for student discipline in them or not? I couldn't find any. If you can't/don't find such, you are posting hot air.

Poll all us "snowflakes" of the nonleft (I'm not "the right"), you'll likely find every single one of them will defend the teacher's rights to say whatever the hell he wants in public outside of work, just not in the classroom. That you continually refuse to acknowledge this difference and instead repeat the above over and over is disingenuous.

You can spare the condescension and the subtle neg, both are transparent. My posts are generally crystal clear. You are on the wrong side of the law on this issue.

My God. Every survey shows 90% of college professors are left and vote Democrat. This is common knowledge, like saying most Rush Limbaugh fans don't like Obamacare.

If you require a "study" to prove the sky is blue, I can't help you. You're too far gone. And you don't need to be discussing politics.

nope wrong. People use free speech every day. This guy did and he used his to say men and women who put their lives on the line every day to protect people like him are the lowest of the low. No talent people. I use my free speech to call him a shitbag because thats exactly what he is. Do you disagree with my free speech above or do you understand now that free speech doesnt mean you get to say things and expect to be protected from criticism?
I love arguing free speech with people who dont underatand it. Being such a simple concept and all.

Sometimes one can assess a gump for what it is. Then its on the gump to surprise everyone and prove them wrong.

Just because he has a Constitution right to express his opinion that does not mean he should be expressing it as a teacher in class as part of the lesson. There is a time and a place for expressing ones opinion. One does not go into a Holocaust museum and question whether the holocaust occurred.
